gentleman and ladies i hope someone can help here,i have a friend who has citizenships in russia and the us,he has worked in moscow for the last 2 years,so he did not pay his u.s. taxes,he is back here in the states,and wants to bring his fiancie here on the k1.can he do without showing w-2's for the last 2 years.any advice will be greatly appreciated.

Does he owe tax? If he was living in Russia he would be exempt on the first $88k of income or so.

If he doesn't owe anything he can retro-actively file, which is what I did as I lived in London and didn't file.....because I didn't think you needed to if you didn't owe anything which turned out to be wrong

if he does owe tax he will be liable for interest

He is probably OK. He needs to file returns. BUT if the income was earned in a foreign country and he paid tax in a foreign country he will get credit for the tax he paid, so it is unikely he would OWE and tax. He does OWE them a tax return. Google 1040/2008 and 1040/2007 for the forms. If no tax is owed there is no penalty. He will have to attach his Russian tax returns if he wants to claim credit for taxes paid.

By the way, in the US there is no such thing as "dual citizenship" The United States considers US citizens as that and nothing else. It makes no recognition of foreign citizenship, nor is it prohibitied. It is a non-issue for the USA.

- it's just a common mistake to call 2 citizenships a 'dual citizenship'. There is no such thing as 'dual citizenship' b/n US and RF. Russia doesn't recognize other citizenship either, nor does US. If your sweetie becomes a citizen of the USA one day, she will still keep her Russian citizenship.. if she is Russian of course!

This is very simple. If she is a Russian citizen now and has her international Russian passport, then she has one half covered. She will just have to renew that Russian passport when applicable.

Then for the other half, she immigrates to the US, gets the Green Card, stays married for the required number of years (or stays the other number of years if not married) and then submits her paperwork for US naturalization. Once she is approved and takes the oath, then she, that same day, can apply for the US passport.

When she obtains the US Passport, she can hold the Russian passport in one hand and the US passport in the other.

Then by magic, she is automatically a dual citizen!

She can use her Russian passport to enter into Russia and the US passport to re-enter in to the US.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

He just has to send a letter why he wasn't required to file taxes. He still has to qualify financially with what he's making now or get a co sponsor to bring his fiancee here.

Except if you are a US citizen you must file a tax return even if you do not owe taxes, living outside the ocuntry is not an excuse to not file!

And yes, the money he is making in Russia will not be counted as support UNLESS it will some how continue "from the same source". He would need to have US employment or a co-sponsor. Also he needs a US domicile, which can be a realtive or anything, but he needs to list that on the visa forms.
