Hello VJ members,

Thank you all for assisting all others in providing helpful advice with the Visa Process.

Now for another question, my husband & I are in the CR1 process in the IV package step and last week my husband called to tell me that the Cairo Embassy/Consulate had sent him a letter on our K3 visa. They gave him instructions on where to go for his medical examinations, etc. The LingChe NVC Shortcut steps say this about the NVC process of a CR1 process (12 STEP):

a. If you were also approved to apply for a K-3 visa (otherwise skip).

If (again big IF) you had simultaneously petitioned to apply for a K-3 visa (by sending in an I-129f) then you may be able to allow that process to continue in order to get an interview date at the consulate before your case is approved at NVC. This requires luck and timing.

  • USCIS will send your approved I-129f to NVC.
  • NVC will "touch" the I-129f long enough to give it a case number and pass it on to the embassy.
  • The embassy will notify the beneficiary of the next steps, and give them the case number assigned by NVC.
  • The embassy will tell the beneficiary how and where to setup the medical exam.
  • The beneficiary can then send in another copy of the DS-230 (just the signed pt.1, no other documents).
  • The beneficiary can schedule a medical exam.
  • The beneficiary can request an interview date, far enough in advance that their CR-1/IR-1 Visa case will be completed at NVC.
  • Once NVC completes the case, the beneficiary should NOT contact the embassy/consulate to request that they change the already scheduled K-3 interview for a CR-1/IR-1.
Instead, contact a supervisor at NVC, and request that your completed package be expeditiously sent to the embassy/consulate. This strategy is not guaranteed, It will vary by embassy.

  • Technically, if you have a CR-1/IR-1 that's ready, the embassy/consulate can not issue or schedule you for a K-3. They also can not schedule a CR-1/IR-1 interview...only NVC can.
  • ANY OPINIONS ANYONE? OR IS IT TO RISKY TO TAKE A CHANCE??? JUST WANT TO KNOW EVERYONE'S OPINION ON THIS PART OF THE PROCESS....

how long have you been married? Everything i have read was to go CR-1/IR-1 visa and forget the K-3. At least with the CR-1/IR-1 he would get a greencard right away and SSN and be allowed to work. A lot of people have had both approved on the same day. they say that it may be slightly longer for the CR-1/IR-1, but you pay less in the end.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

According to your timeline, you never filed an I-129F, so you have no K3 in process and it's too late to start one.

I do know that some people have had luck in switching their K-3 to CR1 at the time of the interview... You are very near the end of the NVC process based on your timeline, you might benefit from a scheduling point of view, however, this will also affect your document requirements and need more originals... If you do not get lucky with the timing, then you will get the K-3 and have to adjust status in the US... But I know that there are many others who have had success in filing K-3s and switching to CR1 at the interview time... Check the regionals to see if there is anyone else from Egypt that has done this....

(PS...Pushbrk, the VJ system does not allw you to enter multiple timelines for K3 and CR1, if they received a notice of the K-3, then obviously they have also filed one)

Thank you Christeen! I wanted to explain this to Pushbrk but you beat me to it. I do appreciate your input Christeen and have decided not to take any chances and stick with our CR1 path. In looking at my timeline, I think we are making fast progress even on the CR1 process. I've looked at the Cairo Embassy timelines and some of the K3 filings have taken longer than the CR1. Go figure.

Does the length of our marriage play any role in the process? We have only been married 4 months...Thanks again for every one who contributed their input to my question.

Probably the safest route... As far as time married, just be sure to collect and gather all the evidence of your ongoing relationship that you can... read the guides and others ideas of things to get... Good luck!
