Is a Tax Return the same as the 1040????

I feel like this is probably a stupid question....but I know that the sponsor (for the I-864) needs to submit either the official IRS Tax Trancripts (which I understand you get back from the gov't or can order by calling the IRS)....OR that they can submit a copy of the Tax Returns from their own records as long as they include the W-2s from their employer.

So my question is this - what does the "tax return" look like? Is that simply a copy of the 1040 form used to file the taxes?

I barely understand taxes in Canada, let alone the US. ;)

The 1040 form is exactly what it looks like or close to depending on the way that they are filed. Most people use the tax transcripts because the embassy prefers it. It shows that your taxes were filed and received by the IRS...hope this helps

We actually don't automatically get tax transcripts like you get Notice of Assessments here in Canada. Americans have to order them (for free) from the IRS.

The tax return is the 1040 (or similar form) but it is not valid for immigration purposes without the corresponding W2 forms that are needed to file taxes. You need to submit copies of both. If the W2s are not available then a tax transcript is your next option. As Malrothien said, you can get them for free by calling the IRS.

What about the State Tax. The IRS transcripts shows only the federal tax returns right? Is there similar transcripts that can be obtained from the state? In my case California.

02-09-2007 : Marriage

I-130 Stage (Filed while I was on Green card)

California Service Center

06-11-2007 : I-130 Sent

08-04-2009 : I-130 Approved

NVC Stage

09-04-2009 : NVC Received

09-08-2009 : NVC case# assigned (Waiting game begins to Upgrade my case to IR-1)

01-22-2010 : Became U.S. citizen (Sent request to upgrade petition from F2A to IR-1 catagory)

02-17-2010 : Case finally upgraded to IR-1

03-20-2010 : Case complete

04-12-2010 : Receiced interview notice.

Chennai Consulate Stage

05-01-2010: Medical

05-04-2010: Interview Approved!!!!!!

05-21-2010: POE at San Francisco

06-21-2010: Received GC in mail

OK, now it makes sense! ;) Thank you for clarifying it! Has anyone heard of someone being rejected (or RFE) for having the 1040 and W-2s, but not the transcripts? Even if it says you can do either one, I was just wondering if they are getting pickier about it. Thank you!

Immigration is a federal matter, controlled by the federal government. They don't care about state taxes. Not all states even HAVE income taxes. You won't need to provide state tax returns at any point on the immigration journey.

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

You request a tax transcript, not a copy of your 1040.

People do receive RFEs for not including the W-2 with the 1040.

Many have no problem with submitting the 1040 and the W-2s. (if the USC is self-employed the Sch C and any 1099s should also be included)
