hi yall! i was just wondering if any of you guys could help me... i was planning to apply for a tourist visa and k1 at the same time. would it be possible for me to be granted for a tourist visa? thanks =]

If you show any intent to immigrate and filing a K 1 shows just that, then don’t waste your time and money on a tourist visa doubt you will even get it.

If you have significant ties to your home country...e.g. assets, job, home and so forth, a US tourist visa is possible. That said, an active K-1 petition "may" complicate your position. tread carefully here....Personally, I would avoid the tourist visa and wait for the K-1 to play out.

All the best,

William.

The K-1 can take 6 months or more. Since you already applied for the tourist visa, make the visit and return for the K-1, surmising you are approved as I outlined above.

All the best,

William

from my understanding about the tourist visa is that you must sho w strong tiessssssss to your native country and if you applied for the k-1 now,,,,,, it shows you have ties to usa ,,which is your fiance, so the tourist visa would be dismissed,so my advice is ,,, forget the tourist visa, it will take awhile to get , even ifffffffffff u get it, also u would have to come back to your country and apply for k1,, meaning leave the love of your life and waiting and waiting,,, so i advice, in a nutshell. dont do tourist visa, invest your money, mind and time, in k1  best of luck to you!

Hey, If you have a good job, own property, car, have money in the back, or have children you are leaving home, and have $131.00 to gamble. You can apply for a B-2 tourist visa and possibly have success. If you mention anything about fiances or K-1 visas on a B-2 Visa that will reject you flat out because you are displaying intent to immigrate and it is the US boarder patrol and US consuls position to believe that anyone seeking entry into the USA is potentially trying to immigrate.

The chances are stacked against you for a tourist visa for sure but it is possible. My fiancee is Russian and she was granted a 1 year multiple entry visa that we used to meet in the US to get engaged. She went home and I filed the petition for her ( For K-1 the US citizen has to petition for the alien fiance(e). You will not be applying for the visa until the USCIS, NVC reviews your petition. Then the US embassy in your country reviews your fiances petition and interviews you.) My fiancee came back 3 months after we filed the petition for 2 1/2 months with no problems.

I would say if you can obtain the B-2 go for it first, then you can file the K-1 while you are in the USA and the normal time given on your I-94 (card that the boarder patrol at the airport stamps) is usually for a 6 month stay, although the US Boarder Patrol can give you a shorter amount of time if they want, they can put you on the next plane back to your country if they want. You can wait in the US with your fiance after you file the petition just do not over stay the time given on the I-94. You will have to go back home for an interview at the US Embassy in your country.

So try to get the B-2 first, then file the K-1 once in America. If the B-2 doesn't work out for you. I would take a good 2 weeks of reading the guides and forums here on VJ. Make sure you fully understand what you are getting into and it will save some heartache down the road.

If the B-2 gets denied this should have no impact on your K-1 petition.

Also, I will assume that you you both have met each other. It is a requirement that you have both met in person in the last 2 years and can prove it.

Best of luck!

I would not file both at the same time. Go for the K-1, as that is primary.

If you have sufficient ties/assets in the PI, as described above, you will be approved. Do you have substantial ties to your home country, in terms of assets, house, job and so forth? If so, proceed with the B-2 and apply for the K-1 after your return. If not, halt the B-2 and go for the K-1.

Edit to add: Chris_Жанна: Different country = different core requirements. It is not as simple as you describe.

Well, the worst thing they can say is "No". Then, proceed with the K-1 if that is the case. It's gonna take a few months for the petition to clear. That's why if you have the B-2 before submitting the K-1 you can go into America and visit during the process or you will wait apart.

Like I said, Zhanna and I had no problems at all with this. Russia is a pretty difficult country to get a tourist visa for a young, single, woman. We were very, very fortunate.
