Urgent help needed with RFE

i got this letter today which was dated 08/10/09 and i have 87 days to submit evidence! which means i have a week to give immigration whatr they need!!

this is what the letter says:

(1) in order to process your application further, the joint sponsor on form I864, affidavit must submit all fedral income tax documentation submitted to thr IRS for the most recent tax year

(2) in order to process your application further, the joint sponsor on form I864, affidavit must submit all supporting tax documanintation(w2s 1099 etc) submitted to the IRS for most recent taxt year

(3) the joint sponsors income on the fedral income tax return does not meet or exceed 125 % of the poverty line. the joint sponsor lists their current income on form I864 as an amount to be considered as sufficent: however no evidence has been submited as proof of current income'

please submit evidence of your joint sposors current income.

my Joint sponsor is a retired teacher and says on her tax return she makes 36, 000 there abouts. my proof can i use for current income??

and what do i need to do for (1) ?(2)?

please help me :(

Her income tax return and all supporting documents (such as W-2's, 1099, schedules, etc). What ever she sent to the IRS is what they will need. I don't know if that is what you sent in.

You mention your joint-sponsor 'says' she makes $36k/year - is that what her tax return said?

All they need is your joint sponsor's tax returns for 2008 and her W2 etc, if she has one. Get a copy of the 2008 return your joint sponsor filed and the supporting document she filed her tax return with. Send those to USCIS.

yes it was around that much she lives on her own! i will have to double check the tax return but im 90% sure it said that

i sent in tax returns. supporting documents would a retired person have!!

I'm not really sure if this is what they mean by "proof of current income," but I know that when I filled out the 864 I sent in a current letter from my employer stating that I was employed and how much my salary was. I know that she is retired, but maybe they would like proof of the source of her retirement income.

Hi,

check out that date with a call. In the UK that date means October 8th, so you can panic less. It is from the London embassy so I am pretty sure that is right, but check.

She may have a retirement income like her social security benefits or income from a previous employments retirement plan. All you need is those docs, possibly her monthly slips of last two months and the tax return.

A retired individual is going to have a 1099 from the Social Security Administration for her pension.

She will also have a 1099 for any other pensions (I'm operating under the assumption she has a pension from the school board she worked for).

She may have other income - every taxpayer is different. Whatever her sources of income are have to be documented.

Can your USC husband help you decipher the tax return? How many exemptions is she claiming (people)?

An important side note - I would be making myself an Infopass appointment ASAP and going face to face with an immigration officer to document my concern (for my case) and complaint of late notification of the RFE. And when I did send my response back, I would NOT send it by US Mail. I would send it by an express carrier.

Right. You should have the opportunity to have enough time to get these things together. A week is unreasonable. Any ideas why it arrived so late? Curious.

I think they only need tax transcripts. Call IRS and ask them for Tax transcripts. Make sure you have a fax number because they wil fax it to you instead of waitting for them to arive in the mail.

I missed this point earlier - this is a concern (as to what happened to the mail being delivered so late) - if you feel you're going to need the proper amount of time (you might or might not) then an infopass appointment would definitely be in order. You don't want to inadvertently run out of time - that would be troublesome.

Back to your question - seems only a few definite answers have been posted.

All three items (#1,2 & 3) are related and may all have been triggered by the lack of documentation for your joint sponsor's tax-return. In other words, 'don't have #1 and/or #2, can't verify #3.'

Not to sound like am repeating what others have said but, retirees get income documentation for the purposes of tax reporting - 1099's etc (it differers sometimes, depending on the source of income). This is what the RFE is asking for. If your sponsor kept an exact copy of everything she submitted to the IRS - that's what you need (exactly the same thing that plopped in front of some IRS agent when it was filed).

If she doesn't know or can't find everything - a simple call to the IRS will get her an official IRS Tax Transcript - this transcript will contain everything needed to satisfy USCIS's request (assuming she does indeed meet the minimum income requirement for the proper household size) - no other tax-related supporting documents would be needed.
