Hi,

I was approved for the K1

So I went to the USA and got married (HURRAY)

We went on a honeymoon to Hawaii,

and I was planning on the paperwork first thing after we came back

But my wife got in a car accident.

Someone driving the wrong way on the highway at 80mph

Shes fine considering the circumstances.

Shes alive and not paralyzed, but were wasting a lot of time and money on

doctors visits, medicine, attorney, dentist, therapists, etc etc ...

And then I got the flu 2 days later thanks to the ER visit,

and its still going strong in my system.

But I need to get my status changed.

And although this website has some helpful sides,

i get very confused atm, also because I only have a little time to get it all done.

I noticed some of the forms that were mentioned, I already needed to have for my K1

like say the G325A and the affidavit of support,

can I just use the same ones ? Or do they need to be filled out again ?

It seems that the early K1 process was explained a lot clearer then the change of status.

Or maybe its because of whats going on in my head right now.

Please come to my aid.

I cant afford to be sent home again and be away from her.

I need to take care of her now.

I am so sorry to hear of the accident but am glad to hear she is recovering. (F)

What I found most helpful was to print out the USCIS instructions, read it carefully, and highlight all the action items contained in the document. Then as you take care of each one, cross it off.

Take some deep breathes and focus on your and her health - glad she is recovering and you are there to assist her. From your timeline you have not been married a month - even if you do not file by the 3 month mark, its okay. However I expect you are anxious to get your work authorization (EAD) - which is free when filed with the AOS.

I found the Guides (see blue bar on the top of the VJ page) helpful. Yes, you will need to fill out the G-325A again. The affividait of support for AOS is the I-864 -- its longer than than the form you used for the K-1 application.

Why don't you start with getting your birth certificate translated - one of the many pieces you will need.

After you have done some reading - bring back your questions.

You can use the same G325A just update it. Petitioner no need the G325A.Have your wife get 3 years of tax transcripts. 800 -829- 1040 . Free and 24/7.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I'm sorry to hear about your wife's accident, but am glad she's recovering.

As for the AOS, It's a lot easier than it looks. But with all the stresses of not being able to work and now your wife I understand how you feel.

You will need to fill out a new G-325A so it's updated. Seeing as you're married now and also your address is now here in the US.

As for the affividait of support, for the K-1 it was the I-134 but for AOS you need the I-864. But all the supporting documents are the same just you need most updated. : Letter from employer, Tax Returns (W2s) for 3 years, Pay check stubs, bank statement, and a copy of the birth certificate or passport.

September 16th - 30th, 2011 -- Damian's Parents came to visit us here in PA.

June 1st, 2011 -- Mailed ROC to Vermont.

February 21st, 2012 -- 10 Year Green Card Received

April 14th, 2012 -- N-400 Sent to Dallas Lockbox

November 26th, 2012 – Damian Became a US Citizen!!!
