A couple months ago my wife lost her passport with her US visa. She came to the US on a tourist visa and we got married 4 months later. She applied for AOS and has received her AP. The day of the incident, we reported it to the police station and received a copy of the police report. She has also contacted the US embassy that issued the US visa, by fax , as requested. Will she have a problem leaving and returning on her new passport she received in the US at her embassy and her AP?

No. If she has a new passport and an AP she has everything she needs to leave and return.

Does she not have a bigger problem in that she now has difficulty during AOS of proving that she entered the country legally and with inspection? Also if she has overstayed her visa she should NOT leave the country until AOS is complete.

you might want to request a copy of her I 94 since she needs it in the interview

I she leaves and returns she will get a new one, no?

Whe did you get married? Within the time allocated to her by the officer at the POE which may be less than her visa, or had it expired putting her into overstay and out of status?

I also have photocopies of her US tourist visa and stamps with the date she left her country for the US. She entered the US legally as a tourist, we got married in the US 4 months later. We also lived together in her home country for 1 yr and have a 14 month old child together that received a US passport in her home country
