My wife recently became a US citizen and my wife adopted her niece about a year ago and received the Final court papers in Thailand. I wasnt allowed to be on the court papers It would have been a much longer process,We have supported her in our house for about 5 years since her parents passed. I Need to ask if it is possible to bring her here?

What forms?

How long could it take??

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

As the child is now the minor child of a USC, yor wife can file for an immediate visa, starting with the I-130. Not sure about Thailand specifically, but it should take less than a year.

I'm trying to do the same thing. There is some weird rule in Thailand that the "adopter" has to live in Thailand for 2 years with the child. Both parents have to be proven dead.

I talked to a lawyer here in the US and he advised to bring her here on a visitor visa, and then adopt her here. I think that is breaking the rules, so I wont do that.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

A legally adopted child of a US Citizen can get an immigrant visa. Issues with Thailand's requirements for adoption are a separate issue from US immigration.

Facts are cheap...knowing how to use them is precious...
