A SYDNEY man acquitted of bashing his older lover to death with a juicer will stand trial again charged with his manslaughter, a court has decided.

The pair had been living together for three years in a jointly-owned flat in Alexandria, in Sydney's inner south, when the much older man was discovered dead on the morning of April 7, 2007.

Neither man can be named for legal reasons.

An autopsy revealed the 72-year-old had died from blunt force injuries to the head and neck and a blood-stained juice extractor bowl and spout were found close to his body.

Taking this together with evidence of a physical struggle and possible strangulation, police charged his 49-year-old lover with murder.

The younger man admitted the pair had been fighting - he presented at the police station with a "Chinese burn" on his arm - but the alternative explanation presented to the court was that the older man had died after falling down the stairs and hitting his head on the way.

The younger man was "hysterical" when he spoke to a friend and police a short time later.

At the conclusion of the younger man's trial earlier this year, NSW Supreme Court Justice Stephen Rothman directed that a jury acquit him of murder and a back-up charge of manslaughter, saying there were too many "gaps" in the Crown case.

The Director of Public Prosecutions appealed the decision and today in the NSW Court of Criminal Appeal Chief Justice James Spigelman agreed.

"A jury is entitled to draw inferences and, in that manner, to 'fill gaps' in the evidence," he said in his written judgment.

"(Justice Rothman) did not pay regard to the other facts to which the jury could have regard ... the evidence of a fight, the absence of any other person on the premises, the time delay before contacting 000.

"Accordingly, in my opinion, the Crown's submission that his honour erred on a question of law alone should be accepted."

However, the man will only be retried on the manslaughter charge.

Angeles City is a seedy place even by the standards of the Philippines sex industry.

One of the most infamous fleshpots in Asia, thousands of foreigners visit the town - two hours drive north of the capital, Manila - to pick up children, some younger than 12, for sex.

Plenty of Australians call it home. But one who won't - for a while yet, anyway - is Terrence William Hainsworth.

That is because the 52-year-old West Australian will be spending the next 13 months behind bars in his home state, after being convicted in the Perth District Court last week on charges of importing and possessing child pornography and bestiality images.

An investigation by WAtoday.com.au has found it is almost two years since he was put behind bars in Angeles City, while awaiting his day before the Philippines judicial system to face charges that he raped the seven-year-old daughter of his Filipino partner.

Wow Mr. B. But he only gets 13 months as criminals in Australian are treated lightly. I guess that's why it's so high on the list of best places to live. Maybe all those polls were taken at the prisons?

Well we know how gay some Australians are. In fact, he'll probably start boasting how the gay Australians are way gayer than the US homos are.

maybe they can outdrink their american competitors.....

They can do everything better than everyone. I wonder what they'd do if they got involved in a war? Who would they look to for protecton? Norway? Canada? Maybe France?
