Instructions: If more than 30 days have elapsed since your NOA1 date and you have not received your biometrics appointment letter, you can call the NCSC (their number is on your NOA1) and put in service request to the service center which you filed (CSC or VSC) to find out the status of the biometrics appointment letter. Make sure to verify the home address and mailing address (if any) with them on the phone. You can also request to speak to an immigration officer (you may have to ask at least twice to be transferred) to get your CR I-89 receipt number, (it is the receipt number of the biometrics letter) so that you can track your case online.

So, today my husband receives a letter from USCIS. He opens it joyfully, expecting an approval notice. No! Not even an RFE, but a notice claiming that he submitted his petition late without an explanation. UGH!

We mailed it May 3rd and received the notice of receipt dated 5/6. His card expired May 28th! How the #### is that late???? Stupid effing idiots. Now I have to make an infopass appointment to get this BS straightened out.

Also of note: The online case status still says initial review.

called NCSC , looks bio appointment not scheduled yet! the officer i talked to sent a request asking to schedule finger prints appointment...

AOS still pending, interview not schedules, after my last call to USCIS i decided to go with N400 instead of AOS

05-07-2011: mailed the package for N400

05-12-2011- Received email form USCIS acceptance of application , also receipt number

Ouch. Sometimes I wonder we should be worried....they sent you a NOA1 3 weeks before the expiration of your card and they are now sending you a notice to say you filed late? :wacko:

Good luck with the infopass and please give an update when you learn more.

Hey,

I know how frustrated you are feeling right now, but I recommend you call USCIS and start this now. If they proceed with the fact that you are a late filer, they might move the status to removal proceedings and then it will get ugly since they wouldn't know what to do....

Get a service request, and have the person on the phone confirm the status and the error. Also, request a written letter to state that it is in error that you received this letter.

With all this, keep your infopass and get things straightened out.

I think if we hired a bunch of monkeys to handle the immigration process, we would be in a much better place right now!

Thanks V33k! Whe I tried to call they said I needed my husband with me and I'm still at work. The VRU there says we are still in the initial review, too. I know the online status isn't reliable at all, but it is crazy to know that they can send out this random, awful BS and yet appear to have no record of it!

Well, after initially speaking with a USCIS nimrod, I was finally moved on to another person at USCIS. She did say that although she couldn't see where a notice had been sent to my husband about filing late, she could see that his file had been worked on today. She also said we should send in all the documentation that we have proving that his application was filed on time. She also sent an email to the officer working my husband's case, explaining that we'd received essentially an RFE in error and that we were concerned about it. Of course, we'll send in our evidence, but its just so pathetic that this has happened.

Updating "journeyman". Received the Bio Appt. letter in 8 days of the first call to USCIS.

We called twice in 8 days:

First time we placed a SR for which we did not receive a response so we called again and then talked to a higher level officer who took down the details and said would write up a report for the issue or scheduling a report. The same day evening we received the bio appt. letter in the mail that corresponds to the first service request. (we know that it corresponds to the first one because the SR # is in the email). Should we call and cancel the second request or just leave it?

Instructions: If more than 30 days have elapsed since your NOA1 date and you have not received your biometrics appointment letter, you can call the NCSC (their number is on your NOA1) and put in service request to the service center which you filed (CSC or VSC) to find out the status of the biometrics appointment letter. Make sure to verify the home address and mailing address (if any) with them on the phone. You can also request to speak to an immigration officer (you may have to ask at least twice to be transferred) to get your CR I-89 receipt number, (it is the receipt number of the biometrics letter) so that you can track your case online.
