Quick question re: I-129F

So I am a Canadian citizen and my fiance is an American citizen. I came here on Sept. 30 and he proposed to me yesterday (Oct. 1) so I'm getting my petition ready. Question 12 it says:

If your fiancé(e) is currently in the U.S., complete the

following:

He or she last arrived as a:(visitor, student, exchange alien,

crewman, stowaway, temporary worker, without inspection,

etc.)

I'm a visitor

Arrival/Departure Record (I-94) Number

I never got a I-94 since I drove and I'm a Canadian citizen

Date of Arrival

(mm/dd/yy)

Arrived: Sept. 30, 2009

Date authorized stay expired, or

will expire as shown on I-94 or I-95

So I'm staying here for 6 months (180 days) unless I have to attend my interview in Montreal.

So would I put March 30, 2010 or is this section only for people travelling on plane or people in visa waiver programs.

Please help thanks

1. Yes, you are a visitor.

2. Under I-94 leave it blank.

3. Date of arrival, insert your date

4. Date of expiry, I would leave that blank since you do not have a I-94.

YOU do not have a petition to "get ready" Your USC fiance has to get that ready.

I guess I do not understand what ytour question is? Are you staying here? How long? If it is just a brief visit then forget this stuff. If you are living here, then answer. I suspect you are just visiting or you would have the information you need. Canadians do not get I-94s for visits and visits do not need to be listed in this section.

This would apply to a foreign fiance who is here on some type of visa, VWP, etc. where you would have an I-94

Sorry I'm a bit confused. I am staying here with my fiance for 6 months so would I put in the expiry section March 30 2010 since I came here on September 30, 2009. I also realize that my fiance needs to file the petition but I'm helping him with it since I'm here.

Yes, or you could leave it blank and just fill in the part of YOUR forms where it asks for you recent visits. The part you are looking at refers to people who are "in the US" for extended periods, other visas etc. You will have forms to fill out in the is process that asks for when you visited the US. You are not "in the USA" for the purposes of the I-129f form.

This may also be our Canadian's response to his SO's suggestion that he take on

a traditional "sex" role of "you take care of the details dear." The US citizen had

better take the active role here because she is the one that has to sign everywhere

and get proof of this and that (at least on her side). She has the active role as the

petitioner along with all it's potential liabilities.

Answer all the questions on the form, what does not apply to you put N/A or none.
