Are you filing for abuse? Where are you getting this immigration number from? I can help you only if you state more information on what document this is presented. You are already looking into abuse and your timeline idicated you have not even had your interview... why? You planning on filing for VAWA? If so that's pretty jacked up

Timeline

212(a)(5)(A) is a proper ground of refusal for IV applicants who are determined not to be eligible for the IV category under which they have applied. For example, it is used to refuse family-based IV applicants when it is determined that the requisite family relationship does not exist (e.g., a marriage to circumvent immigration law, or DNA tests establish lack of paternity/maternity).

A 212(a)(5)(A) refusal is appropriate in these cases because, once the alien no longer falls within a family-based IV category, the alien is no longer exempt from the labor certification requirement that would otherwise normally apply to immigrant applicants.

when we first filled we filed for a k-1 and we had a marriage contract and they diened him the k-1 visa, and they gave him a paper that said that on it and i dont know what it means/.

If you applied for a K-1 Visa but you were married then you would be denied. A K-1 visa is strictly for fiances. K-3 and CR/IR1 is for if you're married. :|

If you applied for a K-1 Visa but you were married then you would be denied. A K-1 visa is strictly for fiances. K-3 and CR/IR1 is for if you're married. :|

so we did the right thing when filled for i-130 then? what will happen with the refused k-1 USCIS says its under review

I would find out why you received the 212(a)(5)(a) and see if your file is officially closed by USCIS.

212(a)(5)(a) is some governance from the Immigration and Nationality Act (INA ) that covers employment types.

Sometimes , for a spousal or k-1 visa, it will get used as a reason for DENIAL - but it's used sideways -

ie - 'not a bonafide relationship' and OH BY THE WAY - we tried to see if you qualified under 212(a)(5)(a) and you DON'T - so .. sorry - here's yer white slip.

For family-based visas and K-1's - it's used ( 212(a)(5)(a) ) in place of OTHER quotable INA regs..

USUALLY - 212(a)(5)(a) is a reference to a person who is getting an employment visa.

Can you tell us WHERE, and in what reference or context, you ran across this usage of 212(a)(5)(a) ??

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
