My sister has a kid 10 yrs old. She wants to live in U.S to be with us (her family). Shes never married. She applied for tourist visa before but denied. She wants to try another one but sole purpose of studying here to obtain her masters. Do you think her way is helpful?

Can you give alittle more background? Any US Citizens in the picture? If she's wanting to study then she needs to be looking at student visas.

:star: Thank you for a very prompt response. I am a U. S citizen and I already petitioned my parents. It looks like its a clear picture and the only problem is my sister. I dont want her to be alone in the Philippines. She applied for a tourist visa while she was in Saudi Arabia for a visit during the conference. They denied her visa. I then call different universities and see if she can go to U.S on a student visa along with her kid. She passed the exam already and the only need to do is to apply and show some supporting papers . My Aunt is going to sponsor her schooling. I have contacted the school and says it wont be a problem as long as she shows theres sufficient funds for her kid as well. My only problem is when I asked a lawyer they said that she can apply for toursit visa and talk to the consulate to annotate that she might be adjusting her status while shes here. I am scared that in doing so, she might be denied again with her kid..she is the only sibling I have so my only dream is to be with her and my nephew. She wass denied twice for toursit visa and now I feel confident of pushing her for student visa but if worse comes to worst then my aunt will pay a lot of money for school. What do think is the best way?

She wouldn't get any visa if she tells them she will do AOS in the US.

Non-immigrant visas are issued on the premise that applicants intend to go back to their country when the visas expire.

Getting a tourist visa doesn't look good to me especially when she has enough funds and support from school for obtaining a student visa.

* they told me that the best reason of vising U.S is she is having a difficulty deciding what university will she be attending since someone is sponsoring her school..Do you think thats okay or not a good idea?.

Fastest method to immigrate = marry a USC :)

Realistically, you should file a petition for your sister to immigrate.

The wait can be long (9-10 yrs), but they should get here eventually.
