Stuck in NVC- More evidence for previous J1 visa

Hi everyone,

I can't express how sad, disappointed and frustrated I am. We submitted our application I-130 Aug 2008 and we are still not done with the whole process. In April 2009, we submitted two PCC from Australia and Malaysia to NVC but received RFE because of the expiration dates. Took a lot of difficulties to apply again and finally submitted to NVC in Aug. Called them today hoping for a case complete and was told that I need to show proof of eligibility when I went to Chicago as a student exchange in 2005 for seven months under J1 visa. NVC is asking for form IAP 66. The problem is i dont have the form. The form was submitted to get my visa. How can I have the form in hand? And the I-94 card was returned to the officer at the exit point when I left US. Can anyone please help? We submitted all they wanted in the RFE and now another RFE?

When are we gona be together that way?

Hi, you should have received doc checklist requesting IAP-66 (or new version DS2019). This is what NVC sends in such situations:

It appears that you have been in the United States as an Exchange Visitor. As

you know, certain participants in Exchange Visitor Programs are ineligible to

receive an immigrant visa until they have resided for two years in their country of

nationality (or country of last residence) following the completion of their stay in

the U.S. An annotation regarding the applicability of the two-year foreign

residence requirement to your case should appear in the lower-left hand corner

of your Exchange Visitor Certificate of Eligibility (Form IAP-66). Please submit a

copy of the form to this office.

If you no longer possess the IAP-66, please

submit a statement containing the following information: 1) The name of the

organization sponsoring your Exchange Visitor Program, its address and the

number of the Program. 2) The date on which you obtained your Exchange

Visitor visa, or date you acquired such status after admission to the U.S. and the

date of termination of your Exchange Visitor status. 3) The country of which you

were a national and resident or, if not a national, a lawful permanent resident, at

the time you obtained your Exchange Visitor status in the U.S. 4) Your

occupation and the field of specialization in which you pursued your studies

during your Exchange Visitor Program. 5) Whether your participation in the

Program was financed in whole or in part by a U.S. Government agency, the

government of your country of nationality/last residence, or a travel grant, if any.

6) Whether you are a physician who participated in an Exchange Visitor Program

to receive a graduate medical education or training. No further action may be

taken on your immigrant visa application until you provide this office with a copy

of your Form IAP-66 or a statement containing the above information.

So if you no longer have IAP-66 follow their instructions. Hope this helps. Good luck!

I know how you feel now... although when we mailed DS-230 with other documents, we also sent all my previous DS-2019's issued to me in the past. We knew we were going to get RFE because of that and we just had them prepared in advance. As the post above states, the IAP 66 is the DS-2019. Now, just try to remember where you put it after you got back from your trip in US. Or you are saying you submitted the form already to NVC? You submitted the form to get which visa? It's not clear from your statement. Also, I wanna tell you that you'd better make copies of passport pages with all visas issued to you to US and also make sure you find that DS-2019 form issued to you from USCIS years ago and have it with you on the day of your interview. You'll need it. I've been asked at my interview for all of them, all forms and documents issued to me for every visit in US or change of status. The council will want to see them. Good luck :thumbs:

I was in UIUC as an exchange student in Fall 2005. I found the DS 2019 for 2005. I extended my program to Spring 2006 and I can't find the DS 2019 that covers till Spring as I left in March 2006 due to family emergencies. Also my J1 visa was valid till Dec 2005 but with a valid DS 2019 in 2006 I was eligible to study legally with the expired J1 visa unless I leave US.

The problem is I have only one Ds 2019. Should I submit that copy and write a statement? Are they going to give me more problems? Really tired of this whole process. Never ending.

Sure, write your own explanation and also provide all the info they require. If you do not have that other DS2019 there is nothing you can do about it.

I participated in a an exchange program from 1997-1998 and was issued a J-1. The program was sponsored by US Department of State (DOS) / educational....(I don't remember the specifics). I had lost my IAP-66, but was able to get an official letter from DOS stating the specifics of the program. I was told that they couldn't send me a copy of the actual IAP-66 because they keep those for only so long (I think they said 3 years) but the data is saved in a database.

Your best bet is find out who the sponsors are for the program. If it is the DOS, go to the DOS site for the program and they have a phone number in the bottom of the page. When you call, they will give you an e-mail for the person that is involved with the program. You contact them (be patent, I heard back after 3 professional e=mails) and they will forward it to another person and that person will send you this letter (FED EX, 2-3 days). Will take you about 1 month, depending how quickly they respond to you e-mails.

I had the same letter, but before that i never had and i have never seen the Iap-66 so i wrote a statement with all the information and it went through for me ;)But i was very very mad...Good luck with all this delaing;)
