Hi,

Im an Ir1 visa holder and i traveled to US, stayed there for 20 days but had to go back to my home country because my mother got sick. Till then I hadnt recieved my GC.

Now, I'm planning to go back to the USA. Will my PoE serve me as a temporary GC while re entering, althought my GC had been delivered to my husband in USA. The PoE states "upon endorsement serves as temporary I-551 evidencing permanent residence for 1 year”.

I asked a lawyer for help and he told me that my visa has expired and I cannot re enter with this PoE, I'm confused :S

its not a stamp. Its printed on the visa sticker.

Issue date: 24nov2008, expires on: 23may2009 "upon endorsement serves as temporary I-551 evidencing permanent residence for 1 year" is written right beneath it! the rubber stamp on addmission is 30april09 and ir1 is handwritten on it!

Well it depends, how long did you stay out of the country for?

almost 4 and a half months

once ur visa has been issued, it's good for 6 months. once you enter usa your visa (that same stamp in passport) is being activated and is valid for up to 1 year, that's what endorsement means... you should be good to come back with the same stamp, np... and please, do take the time and fill in ur timeline... thank you :)

Best if hubby Fed ex you the GC. No idea wht your lawyer is talking about unless the stamp in your PP is no longer valid once you get the GC.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

You do not need to get your husband to FED EX your greencard, it could get lost in the mail. The visa and the IR-1 stamp in your passport are valid for 1 years from the date you first entered the USA, you said you entered in April 09 so the visa and stamp are still valid. You do not need anything else to enter the USA.

The issuing of the Greencard does not void the stamp in your passport.

Hi Mariam,

My parents have the exact situation. Did you find out that if you are fine to comeback to US with the your Permanent Visa, within one year after issuance of the A# or Visa itself?

Please let me know too.

Thanks,

Hooman
