Hi all,

I was married for 2 years and received my conditional GC last year expiring Nov 2010.

Things didn't work out and we are now divorced.

I am thinking about removing conditions by myself since now i basically have a life here( job, friends, pet..etc.)

My question is,

1) How long does the process usually take if I file late this year after our divorce is final?

2) If I file late this year, can I go overseas with my conditional GC while I wait for the removal of condition? My brother's wedding is early next year and i would like to attend if possible.

3) If i wasn't able to leave the country while the removal of condition case is pending, should I file after I attend the wedding?

Yes, you can travel, as soon as you receive your extension letter. In either case (married or divorced) they will extend you residence with one more year. You just need to bring that letter as proof that you are legally here and to the DHS officer upon entry.

You file 90 days before expiration of your green card, not sooner. So, your GC remains valid and you are free to travel until next Nov.

You file 90 days before expiration of your green card, not sooner. So, your GC remains valid and you are free to travel until next Nov.

No, the 90 days before expiration only applies to people who are still married. The OP can apply for removal as soon as the divorce is final.

Better answer but still not quite correct.

The 2-yr. GC is based upon the marriage to the USC spouse. When the marriage ends in divorce, technically the residence is terminated and the GC holder MUST immediately file for removal of conditions, no matter at what time that happens. USCIS can immediately initiate deportation procedures, although they almost never do. You should really file NOW, in order to get the NOA1 extension letter.

1. you must file *as soon as* your divorced, the process can take anywhere from 4 months to 1 years. Refer to threads in this forum for timeline on waivers.

2. yes you can travel *after* your get the NOA extension.

3. Travel only possible with NOA extension. The period between divorce and getting the NOA extension is not favorable for travel.
