I-751 Petition Part 5 ??

Asking about Children on Part 5 do we list our daughter that was born 3/25/2008 here in the U.S. and is a US citizen ??

9/14 2006 I-129F Sent Next day Air

9/15 Recieved and signed for by "Freeman" at NSC

9/19 NOA1 CSC Recieved

9/25 Notice date Check cashed 9/25

9/28 I Recieved NOA1(I-797C) in the mail

12/5 NOA2 12/6 but Approved on 12/5 touch

12/9 Received NOA2(I-797) by snail mail

12/15 NVC has received it..Case # issued...

12/19 NVC shipped to Romania

12/22 Romanian Embassy has received an email from NVC that my Petition is on it's way...

12/29 Packet 3 sent to Veronica

1/12 2007 Packet 3 received Dang Holidays..

1/22 Sending all paperwork(I-134,Bank/Employer letters etc..,)..to Veronica per DHL, 3.5lbs...$144 WOW!

1/25 Recieved notice that She needs to pick up my packet in Chisinau..

1/26 Sending Back Packet 3

2/16 Transit Visa to go to Romania for the Interview approved..

2/20 Leaves for Bucharest overnight drive by bus...

2/21 Medical

2/22 Interview !!!! APPROVED !!!!!

Alls I can say is I listed our USC daughter and got a RFE for USCIS wanting $80 for her biometrics. It took us 3 + months to get it straightened out. Had to get our senator to finally get the petition moving again.It does say list ALL children but they mean children who need conditions removed.

It does say that in the instructions.

DON'T list USC children in Part 5.

They ask for the address and immigration status and there is not enough space to write both. I printed out my form and it came out just with a part of the address and the immigration status is missing. Can I just write same as mine, instead of the whole address???

I have a daughter and she was born here in the States.

Since I don't have children. I only read the form and saw "list ALL children". Definitely follow the instructions then, read it carefully and if it says you don't need to list USC children, then don't.

Well, it's very confusing this part then. I would call USCIS and ask someone about it. If you do include her name, then put she is a US citizen, you can also include that on your cover letter "the form requires to include all children. Our daughter is a US citizen and does not need an AOS, etc" something like that.

at what point in your process did you received the RFE? i made same mistake, i just checked the instructions and it states to list all conditional resident children not USC's. i just did my bio hopefully ii don't get RFE.

yes that sucks...glad u got it all squared away and got GC.. hope i'm good. i didn't even state that she was a usc i just listed our address there isn't enough room. i guess will see. thanks for the quick response.

Well I put our daughters Birth cert. in the package... Wrote U.S. Citizen in the "A# if any" spot and used two lines to put full address and U.S. Citizen again

Hopefully they won't be that blind/####### about it..........

Wow guys I'm going to file next week and I was wondering about that,Now I'm confused :wacko: .Well my wife and I have a 2 months old baby that is an usc and I have a step-son that is an usc so should I :

1) List all our children (our son + step-son ).

2) List just our son together even he is an usc.

3) Not list any of them since they are both ucs.

This is al they say about chidren in the instructions.

In Part 5 of the form, please make sure to include any conditional resident children applying with you in order to have their conditional basis removed, or they may file separately. Please remember to provide their A-number.

That's all they say in the instructions.

They don't say not to include USC kids but as I said I did and had MAJOR problems..
