Hello all, I finally received my NOA1 today, after the mail got screwed up and waiting for 6 weeks! GRRRRR!

I am filing the K-1 for my fiancee from Indonesia and her 3 year old daughter

question regarding unemployment compensation and the K-1 visa. As I was getting the paperwork together for the K-1, I was laid off due to the wonderful economy :whistle: So, on the biographic sheet (G-325A) I put down unemployed. Unemployment compensation is $21,300/yr. Now, the past 3 years I have made over $60,000 - but this year is going to drop because of the lay-off.

Would they assume I am receiving unemployment compensation? But I know by the time they get around to my case in the next 4-6 months I will have a job. I do have one lined up right now, but will not start until mid October. The prospective employer, if need be, can provide intent to hire.

I am just asking, with all the factors listed above, would this be a reason to reject my case, or make things more difficult?

USCIS isn't going to assume anything about your income (petition stage). The Embassy/Consulate (Visa application stage) won't assume anything either, they will look directly at your I-134 (Affidavit of support).

ok, so what I understand, it does not matter if its unemployment or job, it just matters if you have substantial income when they look at the I-134.

Since this is September already and if your yearly salary was 60K you should be able to satisfy the income requirement.

Unemployment benefit will pick up the slack and increase your yearly income.

To be safe, call USCIS with this question. I was surprised how little time I was on hold.

I believe what you said is true: they look at your income and don't care where it comes from, but if it makes you sleep any better, call.

ok, so what I understand, it does not matter if its unemployment or job, it just matters if you have substantial income when they look at the I-134.

For the petition stage - you could be an unemployed billionaire for all they know - it's not part of the decision process (to approve or deny the petition).

So yes - doesn't matter now - will (or could) matter at the interview stage - which will be months from now. :thumbs:

ok, thanks for the replies. I will call them on Tuesday just to clarify, I was just worried about the drop in income from the past years because of unemployment. I know I will be working again when the interview stage happens and when I have to cough up the I-134.

Current, continuing income is what is judged for the affidavit of support. If the annualized earnings from the new job (congrats on that) meets the income requirements then you should be fine.

Not important fopr the petition. They won't assume anything as it does not matter at this point. Hopefully you will be employed by the time of the interview when you have to prove support and the period of unemployment will not matter.
