Timeline

I have a question a friend of mine came here on a visitor's visa and overstayed and while she was here her dad filed a I-130 was approved and sent to the country she came from for her to do her medical and interview, she's here and has a daughter and she is married but he husband is in jail when the I-130 was approved she was underage and now she over 21 and married and now her husband cannot petition because he is in jail. any advice anyone??

03/22/10 applied for SSN

04/01/10 received SSN

04/05/10 received welcome letter dated 03/30/10 :)

No she can not use (under age?) her daughter, and Yes she need to be worried.... She can be looking at a ten year ban, she needs legal advice as in a seasoned immigration attorney. This is what happens when you fail to follow the rules.

is there any reason she did not follow through when the I-130 was approved.

she was here in the US and her documents went to her home country, she said she was afraid to leave at that time because she overstayed.
