Hi everyone...

My fiancee is currently in the air and on her way. VERY EXCITING!

The one thing that looms over my head is something I read a while back when beginning this process...that a K1 visa holder can still be denied at entry.

I'm guessing it must be rare, but does anyone know of the main reasons for this? I would just like to be prepared in case I need to fight tooth and nail to get her in here.

u r just paranoid

just relax if she has the visa she will be here

that happen in very very rare cases.

just keep ur self busy and wait for her to meet u after the immigration

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg

I was denied entry twice due to lack of ties to Canada. It can happen and the USC is powerless to change the decision once it has been made.

Chin up, I am sure it will be fine

I have not heard of anyone holding a K-1 visa being denied entry. If there were problems she would not have been issued the visa. Don't worry - I am sure she will be fine and in your arms soon.

Yah dude your just paranoid in this instance, the chances are so minute its not even worth the worry. She will cruise through, which POE is she entering?

Totally fine, she'll be here soon. Like wise Kathryn said, if there was a problem, she wouldn't have been issued the visa

Thanks everyone for the replies! I just wanted to confirm it was rare...that's what I thought initially and now it seems confirmed.

There are so many nuances to this process, it's better safe than sorry.

Dash of cold water.

Every visa holder is subject to entry requirements. Every one of them. No matter which visa you have. K-1, H-1B, etc.. can be denied - up to the CBP.

With that said, since every person coming here is assumed to be an immigrant (and that triggers most denials because they give CBP the wrong answers), people with a visa that intends for them to immigrate (K_1) do not have to worry about this type of denial.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Doesn't a K-1 (or any other) visa holder have legal recourse though, if CBP say 'no', to have their case heard by a judge before being sent back? I know this is one of the rights waived by people flying in under the VWP so presumably visa holders have that right?

04/04/11 - Biometrics appt (notice received 03/19/11)

11/29/11 - Interview @ Atlanta Field Office - Approved & I-551 stamped
