Need help wit USCIS update, how long does it take to appeal???

hi all,

I got this update from USCIS, does anyone know how long will it take for them to finish the case once you receive this message????

On July 23, 2009, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review"

Right now i am just waiting for VSC to send me a letter to appeal my case but I dont know how long will it take. Some people did it in a year other about 2 years. Anyone know or been in this before????

Kevin and Tuyen are going through the same thing you are... There are actually several that have been returned from HCMC that are in the same boat you are in or ahead of you by quite some time... for some it has taken a very long time.... it all depends on what HCMC said as per the reason for denial on how USCIS will handle it and how long it will take...

Our interview was in Aug 2007. I finally got the NOIR in May this year. You will have 30 days to respond from the time they send it, so have your rebuttal ready.

Get a copy of the blue sheet and address everything the CO had a problem with. I had a 3 page letter addressing their problems and about 50 pages of evidence.

Consulate Received : 2007-06-09

Sent Rebuttal: 2009-05-19

NOA rebuttal entered: 2009-06-05

Case sent back to NVC for processing: 2009-08-27

Consulate sends DS-230: 2009-11-23

Interview: 2010-02-05 result Green sheet for updated I864 and photos submit 2010-03-05

APPROVED visa pick up 2010-03-12

POE: 2010-04-20 =)

GC received: 2010-05-05

Estimates/Stats : Your I-130 was approved in 140 days.

09-15-2009 : Writting test from DVM.

11-03-2009 : Driving Test.

01-20-2010 : Working.

04-20-2011 : Submit I751

04-26-2011 : Received I-797 NOA with Receipt Number

05-11-2011 : Received ASC Appointment Notice

06-03-2011 : Biometrics Apts @ 11:00 AM

I should be hearing back within a week or two. They say 60 days from the time they get the rebuttal, but it also says 6-9 month for a petition.

I'm in the same boat. My file has been closed and sent it back to USCIS. I was told it take somewhere six to eight months. USCIS has very few expert employee in the catagory who will be looking into return files.

I know this is a little late...

My case was sent back as well for further review and was re-affirmed by USCIS precisely 4 months later without giving me a NOIR or NOID, they just sent me the re-affirmed letter of approval and that was that. Now we're just going through the same process as the first time. Hopefully you'll be hearing something soon.

While I was waiting, I wrote letters to the DOS, USCIS and State Senator telling them my story and appealing to them for help as i was just totally clueless as to 'why' this was happening. I did get a letter back from DOS that told me they had checked the records and that it was at the moment out of their hands and in USCIS's hands. They also said that they were sorry that they couldn't give me better news. No, they couldn't help me at that time, but it may have given my case a little attention, I don't know. But better to try what you can than just sit and wonder and drive yourself crazy/

I really hope that by now you've learned 'something' on your case. It's the most difficult part, this waiting and not knowing.

August 10, 2009- Embassy notified via email that they've received the Re-affirmed petition assigned with a 'new' case number as well as mailed Packet 3.

August 20, 2009- Embassy sent as an email attachment, the DS-230, Applicants Statement and Cover letter to Packet 3.

August 20, 2009- Mailed and Emailed request letter to Embassy to extend validity date of petition.

August 25, 2009 - Embassy received request to extend validity letter.

Sept 2, 2009- Embassy confirmed their receipt of the completed DS-230 and Applicants Statement.

October 29, 2009- 2nd Interview date- Visa Approved!

November 4th, 2009- Received Passport with Visa intact!

December 4th, 2009- Fiance arrived in U.S. - MARRIED Dec. 7th!

February 23rd-Mailed AOS Packet

March 3rd, 2010-Check Cashed

March 6th, 2010-Received AOS Receipt Notice

March 29th, 2010-Biometrics

Sept. 14, 2010-GC Interview -Approved!
