I filed for K3 and did CR1 and K3 right after the other. I don't recall having to wait to receive a NOA 1 or 2 from USCIS in regards to I 130 in order to proceed with I 129

Good Luck.

I sent the I-130 for K3 visa for my husband last may the I got the NOA 1 last june, can i count just on this and wait for the NOA2,or I need to sent the I-129...

Are you saying that you have never sent the 129F? You just filed the 130? If thats the case, you filed for the CR1/IR1 not the K3. At this point it would not be beneficial to send in the 129f as it would pull your 130 from its place and probably just cause more wait time. When doign the K3, the K3(129f) should be filed right after the NOA1 for the 130, otherwise you will casue yourself more delays.

**If you filed the 130 "last" May(meaning in 08) and you havent gotten a decision yet, you should call the service center and ask for an inquiry TODAY. You are way past the posted processing times now.

Good Luck and I hope that answered your question :)

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive, and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks!

K3 visas are obsolete at this time. You are lucky you didn't submit the I-129F. DON"T do so.

they're not obsolete if you need additional time to round up the cash.

Money isn't the main issue.

Having to go thru the hassel of AOS to get a GC and SS card is the main issue.

Plus If the K3 petitoner goes belly up before the bene gets the GC they stand a GOOD chance of being deported.

Plus CRs get GC and SS card in the mail shortly after arrival allowing them to work and do all the other things that go with having a GC and SS card.

Some AOS's take more than a year to get GC.

There's more

Yes, you guys are a CR1 (or an IR1 if you've been married over 2 years). You really should call the service center and ask why you guys are still pending since its been over a year.

Good Luck!
