k-1 to k-3

Hello all,

I know k-1 fiance, k-3 spouse, its that simple. I have read many times on the forum that one has to "start over" with the k-3 process if married during the k-1. Just want to clarify what constitutes as starting over, I imagine by applying for k-3, say 2 months after filing for i-129f in k-1 route, I will have to re-file the i-129f and front the costs for the i-130 as well? The i-130 fee is not waived or nothing like that, right?

10/26/2009 - Embassy sends P3

11/1/2009 - P3 received

11/18/2009 - P3 returned

12/21/2009 - Embassy sends P4

12/28/2009 - P4 received

1/21/2010 - Interview (passed! thanks everyone!)

3/17/2010 - POE Atlanta, GA

4/8/2010 - Married :)

5/18/2010 - Mailed AOS packet

6/22/2010 - Finger prints taken

7/2/2010 - Case transfered to CSC

8/3/2010 - EAD received

11/4/2010 - Filed Service Request

11/10/2010 - Service Request response via email - they say to wait 180 days for notice of action. My response - I state politely that their request is unacceptable and inform them that I will contact my senator if I do not receive an appropriate response within one month's time.

12/2/2010 - Their response to my email - I will receive notice of action in 35 days.

12/16/2010 - GC mailed.

12/20/2010 - GC received.

No fee's would be waived, you'd have to cancel your original petition and then refile the i-129 and the i-130. You'd probablly get more specific answers in the CR-1/K3 forums.

No fee's would be waived, you'd have to cancel your original petition and then refile the i-129 and the i-130. You'd probablly get more specific answers in the CR-1/K3 forums.

You pay a new fee but K3 is virtually obsolete. Follow the CR1 guide that starts with filing the I-130.

Facts are cheap...knowing how to use them is precious...

I agree, CR1 makes much more sense now. Look into that over K3.

Timeline

AOS

Mailed AOS, EAD and AP Sept 11 '07

Recieved NOA1's for all Sept 23 or 24 '07

Bio appt. Oct. 24 '07

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08
