hi, i have a friend who has just been married to an american girl. They dont know much about the process, so he contacted me asking. Because i came here on K1, so i dont really know about the marriage visa process, i tried to read but i am confused and i cant help him with anything when i am not sure about the answers i may give. So please i need to know what they have to do? K3 or CR1, i dont want to make it hard for him to understand so i want to know the easiest way. I thought K3 is easier and CR1 needs much work. I dont know if i am right or no. Thank you.

2007-11-8 : Married

AOS

2008-3-03 : AOS sent

2008-3-12 : Check cashed

2008-3-14 : Received Receipt Notices of AOS ,EAD and AP

2008-3-17 : Biometrics Appointment notice date

2008-4-03 : Biometrics Appointment ,,,DONE,,,

2008-5-09 : EAD card ordered and AP approval notice

2008-5-13 : AP approval notice sent

2008-5-16 : AP received

2008-5-19 : EAD Approval notice sent

2008-6-27 : interview appointment letter (for August)

yes i did, but that was why i am confused and dont know what to tell the guy. He doesnt know anything about this process and so am i . I know about K1, but and always thought that K3 is for marriage visa till i saw something about CR1, but it looks a little complicated. So i wrote in here ,to get an advice.

CR 1 is NOT always better.

If a CR1 comes under a lengthy 1 year + delay....one would be happy they filled out the K3, dont'cha think?

It really is all about what is important to them. The CR1 can end up being faster(but more expensive up front)if you can get through the process at NVC(probably the part that you noted as being complicated) quickly. But it all depends.

K-3 can be faster as well when you factor in the NVC processing and wait for an interview date, its cheaper up front but then you have to file AOS(1010.00) after arrival and wait 90 days for work authorization.

Have them both check out the processing times at the USCIS.gov site also. This may help them in making a decision. and here...http://travel.state.gov/visa/immigrants/types/types_1326.html

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.
