I am a Sri Lankan married to American he filed I-130 Nov 2005 [VSC] but still pending. We contact many times about our case but they say the same answer all the time.Why is it taking so long?

Sounds like your "American" is a permanent resident but not a citizen.

A case filed that long ago must have some kind of major problem. You might consider withdrawing the case and starting over. Do you have a clue what the problem might be?

If I were you, I would think about with drawing that case and see if you can start over :whistle: ... it has been way to long, I now couples who starting the process a little over a year ago, and now their s/o are already here and have been here for a few months.. Bless & Respect

hi,

my husband is currently in the US and is a LPR there. he filed the I130 with G325A last Nov 2008, and he get back to me like this Feb of 2009 asking for pictures since i think the center has notified him.

With this, may i ask if how long does it take to process this kind of visa??

hoping for reply...from anybody....appreciate your reply...

A case filed that long ago must have some kind of major problem. You might consider withdrawing the case and starting over. Do you have a clue what the problem might be?

No major problem.

1. Engaged in 2003. Submitted I-129F in April 2003.

2. Married in Sri Lanka in November 2003. Husband stayed for two weeks and returned to US.

3. Application denied December 2003. Reason was we never met before engagement. His brother is married to my cousin.

4. Submitted appeal January 2004. Case still pending.

5. Approval Notice sent June 8 2004. Our families were ecstatic. Notice of Rescission sent June 9 2004. Our families do not understand what is happening.

6. Visited me for two weeks September 2004.

7. Returned to Sri Lanka September 2005. He has been here since.

8. Submitted I-130 November 2005 Vermont center. Case still pending

What steps has he taken to inquire about the case? What has the USCIS told him so far? He needs to call ASAP if he hasnt already.

Just speculating If he got an RFE(request for further information) and he didnt respond timely, the case would have been closed. I saw this happen to another couple who didnt inquire after their case went over the posted times...they let it go very long and then when they finally called USCIS, they found out an RFE was issued, they never received it and since they didnt respond...USCIS term'd the petition. A 4+ year old case of a USC is unusual.

Have him call USCIS, like now. This is not normal, he needs to find out what the situation is exactly.

Sometimes the online system doesnt update. What does the status of the 130 say online?

From what I gather, and correct me if Im wrong...

you guys filed a K1

you got married (which nullifies the K1)

it was denied for not meeting in person

you appealed it

they approved it

then they rescinded the approval ?

you then filed a CR1(130) and it has been almost 4 years since you heard anything.

Is this right?

From all of this....

your K1 is not valid anymore because you got married.

I wouldnt file a k3 at this point since you dont know the status of your CR1 petition AND if you file for a k3, it will just slow you CR1 down(if its even active). IF you file a K3, you should file the 129f(k3 petition) RIGHT AFTER you get the NOA1 for the 130. If you wait too long, you are really slowing yourself down as they will take your 130 out of its "place in line" and put you at the back of the K3 "line"

I still say that your husband needs to call USCIS immediately and try to find out the status of the 130 petition AND make sure the 129f has been closed out. Im betting that you received an RFE and they didnt get a response, so they terminated the petition. Or, the K1 was still open when you filed the 130 which conveluted everything.

Just have him call and find out whats going on.

I would call the 1800 number and ask them to put in a service request on your case. This shouldn't be a problem because you are way outside of normal processing times. I had to do this myself. I received an email the following day explaining that they were waiting on security checks and it could be another six months. Two days later, I received an email telling me that they were mailing me an RFE...As you can see now, I am waiting on my interview.

I know how depressing and discouraging this whole process can be, especially when you are waiting years, but try to stay positive. Call and ask for the service request! You will get a response and then you will know where to go from there.

Yes we have plan going to U S after i get my visa approved.

He did call this month. every month hes calling and sending mail but always they reply "If you do not receive a decision or other notice of action from us within 6 months of this letter, please call customer service".again when my Husband checked they say the same reply.

Currently hes living with me because he doesn't want to leave me and kids.

if you dont mind, can i ask which country are you from? coz im a LPR and file i-130 for my spouse in the Philippines way back in july 2007 and till now i havent receive anything except the receipt! so your husband is a LPR too and its just been a year and hes getting stuff from USCIS already??? what did he do??

coz as far as im concerned, it'll take 4-5 years to process i130 for LPRs.

------USCIS-- married since March 28, 2005 - I130 filed: july 27, 2007

NOA #1: Aug 6, 2007 NOA #2: Oct. 29, 2009 - APPROVED

--NVC--December 12, 2009 - Case# generated from NVC

December 17, 2009 - hubby received his letter from NVC[/font]

April 13, 2010 - received DS-3032 via email

April 19, 2010 - sent back DS-3032 to NVC thru DHL (did not email a copy)

April 23, 2010 - DS3032 was received per operator and reviewed, received IV and AOS bill thru mail.

April 29, 2010 - paid AOS ($70) fee bill

April 30, 2010 - paid IV fee bill ($400.00 each beneficiary)

May 01, 2010 - AOS shows "PAID" in the system, printed cover sheet.

May 05, 2010 - iv bill shows "PAID"

June 24, 2010 - sent AOS via USPS/certified and prioritized

July 14, 2010 - received RFE. nvc is requesting again for Tax Transcript 2009

Sept 14, 2010 - Mailed RFE documents via usps

Sept 22, 2010 - mailed complete DS-230 via DHL

Oct 14, 2010 - received RFE about beneficiary's police clearances

Nov. 30, 2010 - sent corrected DS-230 with correct years of residency via USPS

Dec. 21, 2010 - CASE COMPLETED!!!

April 28, 2011 - interview date was set to JUNE 28, 2011 @6:30AM

June 15, 2011 - MEDICAL EXAM and will be back fri (6/17/11) for results

June 28, 2011 - Interview

July 12, 2011 - arrived at LAX - and we'll live happily ever after!
