can i get more time to file k1 visa?

I want to know if i file for my k1 visa form(130) will i get more time than the 2 years since we first met as my future asawa was married in Philippines when we met in Nov 07 and the annulment will be done next month at last since i could not file until her annulment was done. what i want to know if there a form i can use to get more time while the K1 visa is being done. Nate

From the I-129F instructions:

You may file this petition if:

You and your fiancé(e) intend to marry within 90 days of your fiancé(e) entering the United States, and are both free to marry, and have met in person within two years before your filing of this petition unless:

A. The requirement to meet your fiancé(e) in person would violate strict and long-established customs of your or your fiancé(e)'s foreign culture or social practice; or

B. It is established that the requirement to personally meet your fiancé(e) would result in extreme hardship to you.

The cost of traveling to meet is not considered a hardship.

I want to know if i file for my k1 visa form(130) will i get more time than the 2 years since we first met as my future asawa was married in Philippines when we met in Nov 07 and the annulment will be done next month at last since i could not file until her annulment was done. what i want to know if there a form i can use to get more time while the K1 visa is being done. Nate - it sounds like you've got some research/learning to do ahead of you. You're quoting forms that have nothing to do with a K-1 (the I-130) for starters. And secondly - as stated above - you're not going to get 'more time' to meet qualifications.

what if you have file the within the 2 years will it be ok as i will file this September she has the k130 forms now and will mail the forms when the annulment is done in a few weeks.

Nate - it sounds like you've got some research/learning to do ahead of you. You're quoting forms that have nothing to do with a K-1 (the I-130) for starters. And secondly - as stated above - you're not going to get 'more time' to meet qualifications.

yes i will have some learning to do as this is the first time for me and yes i have everything else including pictures of us (with family) and picture with just us plane ticket and hotel,e-mail and phone texts, letters and proof that i have been supporting her as well . she has the k129 papers as i sent it in a box to her she got it a few months ago. Nate

K1 fiance visa is the 129f form not the 130, and it's requirements are simple and set out plainly.

You MUST meet in person during the past 2 years to file the 129f. Either file the 129f before Nov 09 or go visit her.

Exceptions would be if your social or religious customs conflict with that. Financial hardship does not exempt you from the meeting requirement.

Extreme hardship would be, for instance, if you had a medical condition that prevents you from traveling to a meeting place.

I suggest you read the k1 visa guide here on visajourney until you are very familiar with it.

Filing the 129f properly really is straightforward and simple so long as you follow the checklist and answer all questions carefully and assemble the packet step by step..

There are plenty of people here on visajourney willing to help if you get stuck or confused but take the time to read the guide first.

I don't quite understand how you get the form numbers incorrect?

Especially as you claim you sent her a "K129"! :bonk:

If it's a I-129F she doesn't need it. You are the one that signs it and submits it.

Get working on reading the guides.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

:thumbs: well i did posted the wrong form but my asawa has both the I-129 and the I-130 froms as i sent them in a box and the plan is to file in Sept of this year thank you very much as your help is very much helpful thank you :help:
