Hi Everyone,

We just had our initial interview this morning in Detroit. Everything went fine. The immigration officer asked for a bank statement that shows grocery purchase and other daily stuff (I guess that would be credit card statement) but we didn't have any.

Then she asked me whether I was a member, or have been a member of, or affiliated with communist party. I was a student member of the communist party club while in college for two years but was never an official member. When I filed for the application, I didn't think it was a big deal and to avoid troubles of having to explain, I checked no. I don't know what happened to me today but I said during the interview, yes, I was once affiliated with it. Then the visa officer became very harsh on us, asking us why we did not check yes on the application. I didn't even get a chance to explain I was never an "Official" member of the party not to mention perform any serious role in the party. After that, she told us we would hear a decision from them in the new few weeks.

Do you think we will get rejected? I am deeply worried. Other than this communist question. we have a very strong case. We are both in our late 20s. This is the first marriage for both of us and I have been a F-1 student in the U.S. for over 6 years now. I just graduated with my PhD and just got a job. Is there anything I should do now? What if our case does get rejected, can we appeal? Can I legally stay and work in the U.S. while appealing?

Hard to tell, but misrepresentation is very hard to overcome, no matter how small.

You will have to wait to see what happens. If it gets rejected, you will have a small window to appeal it.

If that happens, a good immigration lawyer would be advisable.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Just curious....who interviewed you? Did you get a white piece of paper with anything checked on it after the interview?

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

On our interview notice, it says officer green? It was a lady in her 30s? I didn't get anything after the interview.

Just curious....who interviewed you? Did you get a white piece of paper with anything checked on it after the interview?

You are right. Sigh. We were so busy with graduating, jobhunting and relocating. We didn't sit down and review our application material carefully. We should have been more prepared.

Get a good lawyer lined up just in case. I can't answer all of your questions, but this is serious, as you already know. I wish you well.

Wow, you are so good. Where did you get the numbers? I have the email address for Thomas Brownrigg because he sent us an email before about the re-scheduling thing. If we call them directly, would that upset them?.... I am very afraid that I am going to push the wrong button.

We got a piece of paper after our first interview with those numbers on it. I actually did call Browning and had to leave a message, but he called me back...it was about my husband using his AP at the time. I would call him and leave a message and explain to him what happened and ask him if he knows what is going on. Perhaps you, too will have a second interview, or possibly maybe background checks were ordered ???

You should have not lied in the application. Remember the application line where you sign you are certifying everything is true under penalty of perjury....

the question reads: Have you ever been a member of, or affiliated in any way with the Communist party....

hence, you lied in your application. and like Bobby said, misrepresentation is a HUGE no no. Get an attorney.

Sigh. If I were going to lie about it, I would have done a better job covering it up. It was 10 years ago while I was in college. It never occurred to me that it was a big deal being a member of a student club.

But you are right. I was just stupid.

You should have not lied in the application. Remember the application line where you sign you are certifying everything is true under penalty of perjury....

hence, you lied in your application. and like Bobby said, misrepresentation is a HUGE no no. Get an attorney.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I just talked to a lawyer. He said, it's unlikely that the case will be outright rejected because at least I was being honest and explained the situation during the interview. It's better than I said no and later they found out that I lied. But still, he would not surprised if the case gets rejected or accepted.

Anybody has any idea as to EAD card and AP if the case gets denied?

I believe you will still pass. As long as you explain honestly the mix up, shouldn't be a problem. You have to intentionally lie and continue to do so to get in trouble.

you've been here for awhile and have an advanced degree. I highly doubt you will be denied. I would let it go for now and wait for a response. I wouldn't over react. is it na xing? patience.
