mine took 6 months, just check the USCIS processing times. You will know the reasons when you get the NOID. that 30 days they give you to respond goes by fast so I would just prepare for what ever you think it might be, I sent a 2lb box of papers and photos.

What the hell does that mean? Does that mean they were suspicious of them at the interview? If they didn't believe their relationship, why didn't they just tell them at the interview? Why put them through all that AP n then send it back? Dear God I feel so bad for you, I really hope you get through this soon. These stories freak me out. God help us all...

If a case was put on AP, that means the interview went well. Everything was fine at the interview.

They probably found something at the AP stage which made them send the case back.

Does not have to be confirmed but for further checks it was sent back.

It means that they found something out and it needs to be investigated more closely. They do put cases in AP and have seen a few from Islamabad in AP over 2 years before they were denied. In all cases they were considered fraud and do know two persons personally and it was fraud on their fiance/spouse's part not the ladies. Heartbreaking, but the investigations found out many things over the long AP's like hidden spouses or other relationships that they continued.

Hopefully, the OP will not have such bad news and can overcome the returned petition.

L179 you are correct that something probably came up in the AP and it is now being looked at more closely.

Everything I respond to is from personal knowledge, research or experience and I am in no means a lawyer or do I claim to be one. Everyone should read, research and be responsible for your own journey.

How long it will take is speculation as well.

Suggest you read the pinned thread on the top of MENA forum about returned petitions.

Good Luck!

You could contact USCIS, but otherwise, in my case, it took 18 months to get a written explanation of why her K-1 visa was denied. She was told one reason at the interview, and the written explanation which arrived last month gave a different one. It offered a chance to appeal, but by then (because she was told it was due to age difference) there was no point in pursuing the visa from the time of her denial.

I sympathise with the OP and I can say that some responses on here are SO WRONG, they sometimes send cases back for no reason and I have been through it. Our case was sent back only to be reaffirmed without the USCIS asking for further evidence, which in itself baffles me because we really wanted to know why the case was sent back in the first place. Don't go hounding your man thinking he's cheating on you, the CO's in most third world countries are power drunk and they sometimes make up false allegations or 'hunches' just to send cases back. Just contact your congressman/woman to pursue the case and find out where it is and start gathering documents incase you are issued with a NOID/NOIR. I wish you all the best.

I never posted my response to the OP. It was to ABENITEZ that was asking about why they do not deny at the time of the interview. Been on here almost 5 years and have knowledge especially dealing with Islamabad.

I wish the OP all the best and agree that they should contact their congressman/woman and read up on returned NOIR/NOID procedures.

Yeah it was a wait but we spent that time topping up our qualifications and we honestly didn't know it would take this long but we are hopefully at the end by God's grace. Just don't let the stress of it all put a strain on your relationship which is more important. They are now paying attention to returned petitions, so you should hear from them in less than a year. You are in my prayers and you'll definitely get past this stronger! All the best.
