Situation: I have filed the I-130 with USCIS and received my NOA1. I then filed form I-129F for a K-3 visa. I have not heard anything back from USCIS. Its been about 30 days now. I have been reading the forums and realized that my best route to take would be CR1 visa. Thank you all for this advice!!!

Question: Was I suppose to inform USCIS that instead of going the K-3 visa route I am now interested in applying for the CR1 visa? Or do I wait to get the approval for either the I-130 or the I-129F and inform NVC?

I appreciate any input on this topic as I am a newbie to this.

USCIS approves petitions... Department of State issues visas...

When the petition(s) is/are approved, then the case files move to the Department of State at which time you choose your visa path.

USCIS approves petitions... Department of State issues visas...

NVC is part of the Department of State. So are the embassies. The embassies are where the visas are actually issued. NVC simply accepts your application for the visa, acknowledges that you have all the components. It's up to the embassy whether or not the visa is issued.

Once you've filed the I-129f you can't tell USCIS that you'd rather pursue the CR-1. Just wait for the petitions to be approved (which will likely happen at the same time) and then ignore the K-3 correspondence.

Just wait and as soon as both petitions are approved you will make a desition which way you want to go, but keep in mind that CR-1 is beyter definitely better. :thumbs:
