anyone LPR who file i-130 for spouse...

---let me sum up my situation :star: ---

I am F1 student, Married to LPR, living in USA.

I-130 petition filed March 2006, priority date is March 10,2006

Approved I-130 May 27 2009 ( I-797)

Sent out I-485 on Jan 13,2010.

Little bit of bad news for me...

I received Rejection Notices from USCIS. :crying:

They sent back all document and fee check with I-797C Rejection Notice (each notice attach to I-485,I-765.I-131).

The Rejection Notice of I-485 said,

' The check amount is incorrect or not has been provided. The correct filing fee is $930. --abbr.-- also include an

additional $80 fingerprint fee.' ( I sent correct amount of $1010.00...)

' Based on the information you provided,your priority date does not appear to be current. --abbr.-- When your priority

date is earlier than the correlating cut-off date listed in the current Visa Bulletin,you will then be eligible to submit your

I-485 application.'

Other Rejection Notices of I-765,I-131 said, ' The check amount is incorrect or not has been provided'

So, I should have waited to send document till my priority date become current !

Even though USCIS person told me that I can send them now... Oh, yeah, I can't trust them anymore :no:

I know It's gonna be soon to be current and I will be able to resubmit.

But still feel pretty bad :cry: ,because my priority is only 10 days behind the Visa Bulletin!

(now it is March 1 2006, mine is March 10 2006 ), result is that block me off ...

I have to redo my paper work with lack of energy .... sigh ...

Regarding your question, yes,I did not get anything after I-130 Approval notice.

No contact from anywhere made me worried and called both NVC and USCIS

(also e-mail to NVC for inquiry), then figure out the procedures.

I am still attending school and keep maintaining I-20.

Once I get a NOA for I-485, I am going to stop attending.

I am sorry :( to hear about the rejection notice. The people who work at the answering service in USCIS and the actual officers seem to rarely be on the same page :angry: , actually what one tells you the next one won't :bonk: . But looking at the bright side you have all the paperwork ready and just maybe redo some forms and your priority date is around the corner :star: , soon NVC will update the Bulletin and you'll be ready to go. Just be patient - only a week or so to wait :thumbs::D

I will be done with school soon too (finish my degree) and I will have to apply for my OPT to extend the time here. I hope that I can get a job within the 90 days otherwise start school all over again until I apply too. When will your spouse be able to apply for citizenship?

Hi VJ Family!

This VJ has been very informative and helps us a lot in our concerns. Today I just spent almost six hours in this site reading the forums and the guidelines.

Im from Philippines and my wife and son migrated to U.S. last June 2009 and got their green card. They went here last November and we got married this January before their return to U.S. Now we want to file I-130 as soon as possible and Im the one preparing the necessary documents and just send it to her thru LBC when I finished it.

Now Im just little confused in filling-out the I-130 forms.

First, do I need to write in the petitioner’s name her name as written in her green card or she will have to use my surname now since we’ve just got married. If we write my surname now, will there be any problem that may arise?

Second, is it okay to right her name in the petition as written in her green card then update/change it later when she renew her green card.

Third, can we file the petition now or we need to wait for her new green card which bears my surname in it so that there will be no confusions in filing it.

Please help and give us some ideas about this.

the thing is you have to send ALL your documents in their original form, and you also send in photocopies. Be ready to send in the original or Certified True Copies of your Marriage Certificate, Divorce Certicate (if any) Beneficiary's Birth Certificate, Children's Birth Cerificates, photocopy of beneficiary's and children's bio-data page of passport, and any other document you deem necessary for your application.

A week ago I decided to call up Customer Service, they gave me a response to my case it wasn't good at all.. It bring tears to my eyes, that gave me sleepless nights, thoughts and fustruation. This is what I got

*Based on your request we researched the status of this case. We are actively processing this case. However, we have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice of action from us within 6 months of this letter, please call customer service at the number provided below.*

I have so much doubts and mind less thoughts in my head. I've waited so long and patiently. But then again there's no one to blame. The world has betryed me, and my heart has left my soul in a deep dark tunnel.

What's the Point of calling someone your spouse *husband wife* when for 7 yrs engaged 2 yrs marriage when your never there to cuddle or laugh or joke or LOVE. I see no point I see no reason to even call it marriage i call it a big joke.

i myself has an error to the application that i sent and my case was approved Oct 29, 2009... you are the first one here that has similar PD with mine which is July 27, 2007. but someone from here adviced me to wait till they will start to process my file over at NVC and we can send a letter stating the corrections and for you... you can update that and send a letter stating that you just had a baby.... but im sure you dont have to file a separated petition for that...if you can read from the previous post since someone really had the same situation and turned out perfect which they all came here in the US at the same time... then you can get some idea from it.

if your case is already current, ive read some of our friends here that sends stuff to NVC but im just not so sure where to address that... let's wait till our friends will be here and they can give you a better answer. but for the mean time, have you received anything from NVC already? i mean aside from your case#?

Raymon, if you're still an LPR and you already have an NVC Case Number, all you need to do is add your child to your wife's petition. Type up a letter and send to the NVC stating that you want to add your child to the petition. Include a photocopy of your child's birth certificate. Make sure to include the following details:

NVC Case Number

Petitioner's Full Name and date of birth

Beneficiary's full name and date of birth

Mail the letter to the following address:

National Visa Center

32 Rochester Avenue

Portsmouth, NH 03801

If you are already a USC, then you will have to file another I-130 for your child.

F2A for Wife and Son

Priority Date: Mar 23, 2006

2006-03-21: I-130 Sent

2006-03-23: I-130 NOA1

2009-05-28: I-130 Approved

2009-06-02: NVC Case No. generated
