Hi everyone i posted this on another forum but maybe someone hear has some more experience.........my husband had his interview today, he said the co was very nice and and that he was approved BUT they co wants me to send a small "no tax" note stating that i dont work therefore i dont file taxes, signed and dated ???????? He gave him a paper stating that " It cannot issue you a visa at this time under section 221(g)" also, " In order to complete processing of your visa application, please provide the following" and it says "no tax note from petitioner". Basically just a few lines stating that i dont pay taxes because i dont work, and i am dependant on my father because in our customs it is not necessary for the female to work. it does not say he needs further review or that he is denied, just that to complete processing send tax note.

I cant believe it, i started crying when my husband told me, he was assuring me that the co told him everything was perfect and as soon as i send this note and my husband sends it to them then they will call him to send his passport.

I HAVE ALREADY TYPED AND SENT OUT THE LETTER, HE SHOULD GET IT MONDAY. HAS ANYONE EVER HAD THIS KIND OF EXPERIENCE WHERE YOU HAD TO SEND IN ADDITIONAL DOCUMENTS????????? HOW LONG DID IT TAKE FOR THEM TO ASK FOR PASSPORT, I FEEL LIKE IM ABOUT TO BREAK DOWN!

I WILL APPRECIATE ALL THE HELP FROM YOUR RESPONSES.

You were given a few responses in the other thread, like one stated make sure this is the only thing they are asking for and get it there ASAP. Or are you looking for a different answer?

Since you provide them with a written statement on why you didn't file/owe taxes, you will have to wait to see if it answers the request.

Nothing to do but wait.

Yes - I have seen this before, since it states in the 864 instructions that you must make this statement if you didn't file taxes - so that leads to an RFE - which is what you have.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

hi i just sent my husband the letter this morning, it should arrive on monday. The consul approved everything, i even sent the 2008 tax return and updated i864's for my husband to take to his interview (using my fathers income). My husband said the co was very impressed with everything and our evidence, he told him everything looks good but we just need a letter from petitioner stating she doesnt file taxes because she doesnt work. The co told him its not a big deal, and for me to send it to complete his case, then they will call him to send his passport.

I just wanted to know if anyone has ever been requested to send in additional information after their interview, and how long did it take?????????. This is just hard for me because i havent seen him in 10 months, any advice is greatly appreciated, and i hope everything goes quickly and smoothly and he gets his visa soon. i really htought today would be my happiest day, so down...

my husband appointment was September 11 in JRS, they also told us we needed more documents, i am getting them all ready and will send them soon, i hope it does not take too long for them to reply and issue his visa :crying:
