I've heard of so many reason for the consulate denial, but I have a friend of mine whose K1 got denied at the Haitian Consulate, they sent the paperwork back to NVC, The couple wrote NVC from here and submitted futher proof of their relationship, and this time around without even giving a Second interview

The consulate wrote back to the couple and to NVC, they don't beleive the relationship is geniune and they can see a strong ressemblence even though they don't look like siblings, maybe racist from the consulate part, i guess thinking all black people lookalike, really upseting.

They even accusing the relationship is fraudulent only to obain a visa to migrate to the US.

My friend tried the congressman office but so far no help, they are willing to take a DNA test to establish there's no blood relation between them, from far cousin, uncle or any previous generation relationship.

An Embassy/Consulate is not in the habit of denying Visa's simply on the basis of photographs - and since no one hear knows all the particulars of this person's case, we can only make judgment calls.

I seriously doubt however, the employees of the US Embassy/Consulate believe 'all black people look alike' - these people live and work in these countries - often times citizens of the host country are even employed in certain positions within the Embassy/Consulate.

IMO - there must be other, non-disclosed, reason(s) for the visa being denied.

The REASON is that the relationship, in their opinion, was primarily for immigration purposes. This is a valid and common reason to deny. The resemblance is merely part of the "body of evidence" supporting the decision, it IS NOT the "reason". A DNA test would not change the outcome, they believe it is a relationship for immigration benefits. In some of these cases the couple has been married and re-filed for a CR-1 with success. Never use the words "boyfriend" or "girlfriend" in this process. :bonk:

To suggest the US consulate in Haiti is racist against blacks is preposterous. Who are they issuing visas to then? Your friend did not prepare for the interview and was denied. Failure to prepare is preparing to fail.

Moved from K-1 to Embassy/Consulate - relates to consulate.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

It certainly sounds like they had suspicions all around, and that the "strong facial resemblance" only served to further it.

08/21/2009 - AOS package sent

08/28/2009 - NOA 1 for AOS, EAD, AP

08/31/2009 - Cheque cashed

09/05/2009 - Biometrics notice received

09/23/2009 - Biometrics Appointment

09/23/2009 - I-485 Transferred to CSC

10/02/2009 - EAD Approved (card production) & AP approved!

10/11/2009 - EAD Card received

10/20/2009 - AOS approved, GC card production ordered! (53 days in total)

10/26/2009 - Green Card received - nearly 11 months to the day of our K1 NOA 1!

11/25/2009 - Started my new job!

02/26/2010 - Passed my driving test :-p

07/20/2011 - Eligible to remove conditions

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)

VERY WEIRD

When your friend puts aside his feeling of being picked on, out of all the black people that go through the Haitian consulate, because HE was black, then he can move forward and go about correcting the issues that really got his visa denied. He ought to speak fairly good French and be able to say F-I-A-N-C-E.

Present good evidence of a legitimate relationship and a DNA test if they think it is needed. Get married and file a CR-1
