Hello everyone,

I am looking for some advice please, not looking for opinions or nastyness but kind advice.

I applied for a K1 Visa and moved over to USA back in 2007, my Husband and I got married in the April and I had my green card by the end of Aug 2007.

Unfortunatly due to many many reasons we decided to seperate and I moved back to the UK September 2008, I returned my green card in may and recieved my paperwork regarding this a few weeks ago.

Anyway my husband and I are talking again and thinking of giving it another go, we havent decided yet on what we will do, but he might come and live in the UK or I may go back to US.

I just want to know, how and what I need to do if we did decide I would move back to USA?

I would think you start all over again from the beginning except if you are still married then you'd use one of those visas.

Ouch - you should not of surrendered your green card.

What if my green card has been taken by or given to someone in the US government?

If you’ve surrendered your green card, this doesn’t necessarily mean that your status as a lawful permanent resident has changed. Your status will not change unless and until you get an official notice from the U.S. Citizenship and Immigration Service (USCIS) that there has been a final administrative or judicial determination that your green card has been revoked or abandoned. You can contact the USCIS to check the status of your card.

So from what you wrote, you have the final determination - so your status is no longer LPR.

So you probably need to go through the process again to get another visa/green card.

I would recommend a lawyer - perhaps they can work out something?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I was under the impression I needed to send my green card back if I was out of the country for more then 6 months...... AGHHH!

That $ucks!!! You will most probably need to reapply for K3 or CR1..

Ya, Im with everyone else. I think you will have to go back through the process again.

Are you guys still married?

For what its worth, I think its a good thing to try all avenues before deciding to call it quits all together. :) Good Luck on whatever path you guys choose.

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

05-07-2014 Got an email & paid the AOS fee (4 days); DS-261(Choice of Agent) sent


05-09-2014 AOS status "PAID" (2 days from the date the was paid)


05-22-2014 AOS docs delivered in NVC


06-27-2014 RFE for I864 and I864A (i left the Place of residence blank, 26 days from the date they received the AOS)


06-28-2014 Mailed the corrected forms to NVC


06-30-2014 NVC received the AOS corrected forms


07-01-2014 Received IV Bill Invoice, paid.


07-02-2014 PAID status of the mother


07-07-2014 PAID status of the father


07-08-2014 Mailed the supporting docs

10-10-2014 Mom mailed the NBI Clearance of my dad


10-14-2014 NBI clearance delivered in USEM


10-06-2014 Visa Issued CEAC


10-09-2014 Got an email that my dad's visa was issued
