Property to suppliment income?

We are only 2k short of the required income. My mother is the joint sponsor, she makes 21k but we need her to make 23. We are thinking about using 2000 in a savings account to supplement the income. We can do this, but how long will the money have to stay there? Will the USCIS check the account? Or can it be just make the account, get a paper from the bank to prove that you have 2k, and then take it after a few days?

My mother also has a home, but she hasn't finished paying off the mortgage. Can this home be used to supplement income?

What about a car?

A car can only be counted if it is a second car, NOT primary car.

For example I own 2 cars, one I drive every day, and another that is a collectible car that goes to shows. The collectible car can be counted as an asset, and will need an appraisal attached to the I-864 if it is being used.

And correct about the asset value.

For primary sponsor (Spouse) assets are worth 1/3 income, and for joint sponsor assets are worth 1/5 income.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Thank you. But can anyone please tell me if we can use the house to supplement income even if it is not fully paid off?

They would probably consider the equity in the house, however, one of the instructions state:

Assets may supplement income if the consular or immigration officer is convinced that the monetary value of the asset could reasonably be made available to support the sponsored immigrant and converted to cash within one year without undue harm to the sponsor or his or her family members

I think selling your house to support the immigrant could be construed as causing "undue harm" (ie lost of residence). In reality, it's up to the IO what they want to consider, you may want to check this FAQ out:

864 Faq

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

If you live in the same house as your mom then she can fill out the I-864A where her income will be combined with your income.

Read the instructions for the I-864A to see if this would apply in your case. -> http://www.uscis.gov/files/form/I-864A.pdf

You and your husband's combined income is 2K short of the 18,212? Mom can do the 864A along with your 864 since she did claim you in 08. If she does not claim you in 09 and you are not living there then she cannot do the 864A, only the 864.

Current income is the important part. If her employer letter and pay stubs show that she will have enough income then she is good. However, you will be included in her household count as you were claimed as a dependent for her 08 taxes.
