Hello, I'm new to this forum so please excuse me If I ask something that was asked before. I want to get married to my girlfriend in Peru, but currently she is waiting for her divorce to come through which should be completed in Aug 2009. My question is would I be able to get married to her maybe in September assuming of course that she has already her divorce papers. I am an American and I have never been married and I want to get married to her as soon as possible because I don't know how long the process is going to take. If we get married in September 2009 when approximately will she be eligible to be in the United States. What papers will we have to file and do we file them in Peru or would I have to file them here in the US. Please help.

Yes, once the divorce is final and she gets the divorce decree in her hand, you can marry her the next day if possible.

Now about how to bring her to USA. You can't file in Peru unless you are living their for at least 6 months and then apply for DCF. Assuming you will be back in US after the wedding, please file CR-1 visa. K-3 and CR-1 visa takes app. same amount of time and with CR-1 she can come and work in US asap also CR-1 is cheaper compared to K-3.

Please start by reading through the guides, you have lot of time to understand all of this before you get married, so prepare yourself.

Take a lot of pictures when you go to Peru to visit her, letters, emails, phone records, bills of buying wedding ring or wedding dress, as many trips as possible you can make to Peru.

Also not trying to scare you or anything, but her current divorce may be scrutinized at Consulate level. It all depends upon if she was still living with her husband when she met you or not, just things like that. I am not asking you any question, but just giving you a heads up about what to expect.

Please be in these forums and read as many threads you can related to Spousal visa, which will give you a good idea of what to expect and also how to prepare. There is no time limit of how soon can she come over to US, as this process is kind of unpredictable, she can be there within 4 months then again it can also take 2 years time.

Thank you so much for your quicke response. Yes I will read further on CR1 Visa to have more information. As far as my girlfriend she does not live with her husband at this time because he is right now in Israel and he has been there for the past year and half. I hope we have luck and that we can be together here in the US as soon as possible. Thank you once again for helping me out.

Hello and welcome.

My husband is from Peru as well and we went through the whole process and he moved here back in October. We did the K-1 (fiancee) visa instead of getting married in Peru and then filing for a spouse visa, because I heard it was faster and easier and I feel that it was.

As Trinket said, read the guides. This is amazingly valuable information. Once you start compiling information, if you need anything feel free to ask.

You can only file k-1 after she gets her divorce decree. The requirement for K-1 visa is that, the couple should have met physically within the last 2 years of filling.

K-1 is the fastest visa but she won't be able to work as soon as she comes to US. She will come to US as your fiance and then you guys can get married here in US legally.

These are the guides for all the visa and their requirements. Do read those and do choose wisely according to what suites you the best.

The US Citizen applies for nothing. They file a petition, which when approved, allows the foreign fiance(e) or spouse to apply for a visa.

I got married in peru on Sept. 19th 2008 my wife entered the USA on May 19th 2009 on a CR-1 Visa. ( a couple of weeks ago)

I didnt file until november 2008 because it takes time to get all the information together. Most of the time it takes to get it done is info collection. If you want to get it done fast then start right now and the day she is able to get married file the papers (for a K-1). I would do the CR-1 though if it were me. Its cheapr and takes about the same time. The process for us took 6 months and 5 days after filing( 6 months to the day if you dont count DHL).

When one enters on the CR-1 you will be able to work, get a SS#, get a drivers licence and travel out of the country. None of which is possible on a K-1 until you adjust status and that costs more money. I think the #1 complaint I hear on VJ is my wife is bored she is not happy she wants to go home becasue she cant work drive or do any thing on her own due to the K-1 visa.

If you want to get married in Peru start that process now also. You need to get things together and letters and so on. You will defninately have to wait untill the divorce is final as they as for proof of single status. Do fact finding now what it takes and where to do it. In Peru each municipality is different in their requierements we found one in Arequipa that had the least amount of requirements and went there.

Just a side note. I found this out after I had gotten married ( no one said any thing to us about it). In peru to get married you have to sign a paper(some kind of form) that allows you to sign documents in peru IE marraige licence.

I did not do this I guess becasue of that my status of marraige could be contested but she is here now. This document also would allow you in the future to buy property, rent an appartment buy a car and so on if you ever decided to live in peru.

Yeah that is true. We're having our religious ceremony there in December. It's costing us about 10x less than it would in the US plus all his family gets to be there. It's a win/win deal.
