VAWA - divorce - new marriage

let's say i have i-360 VAWA pending, and I'm going to get divorced and get married again. would it lead to denial of new i-130 and i-360 in the same time?

I-360 VAWA:

November 1 2008 filed.

November 21 2008 NOA1

November 25 2008 RFE #1 received [good faith + good moral character].

January 7 2009 RFE #1 sent back.

June 9 2009 received a letter "Response to RFE #1 received on JANUARY 13, and case processing has resumed"

August 17 2009 RFE #2 [good faith].

October 27 2009 RFE #2 sent out.

October 28 2009 Response to RFE #2 received, and case processing has resumed

October 29 2009 touched

December 30 2009 touched

December 31 2009 touched

February 8, 2010, APPROVED.

September 4, 2010 touched.

AOS:

March 18 2010 I-485 filed to VSC with a fee waiver.

March 22 2010 I-485 received.

April 13 2010 NOA1 with a "fee previously collected"

April 16 2010 touched. Biometrics appointment sent.

April 30 2010 Biometrics appointment date.

Wait - you want to get a 360 on the first marriage, get married again, then do another 360?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

U will be denied I-360, further more, you will be denied at the I-485 interview, as it would seem the only reason you entered the marriage was to gain immigration benefits. hmmmmm, so the question is, are you trying to gain immigration benefits by entering into a fraudulent marriage?

No, what if get married and will have kids. FOR REAL, not for green card. So we will have to just NOT tell USCIS that we are married?

but what if they deny my I-360 and I'll be married for 5 years by then, and have 2 kids, house and etc. Would it be still suspicious? :huh:

people who have been the victim of abuse rarely marry quickly after seperation from the abusive relationship.

i know a guy who was abused by his wife for some years, emotionally, physically, and through adultery. she finally left him to go live with another guy, her husband keeping the kids she had no interest in. thereafter she repeatedly attacked him in his home and swore out affidavits to have him falsely arrested. the guy finally got an ex-parte order against her and things cooled down. he was able to force the divorce she contested 2 1/2 years after separation. he couldn't have a normal relationship for more than 5 years.

More information on your situation is needed if you want anyone to give a good answer to the question. In any event, if there is an abusive marriage then you need to end it and not be so concerned about immigration matters. If you wish to remarry, don't even think of trying to be untruthful with USCIS.

Remarriage during the pendency of an I-360 case results in a denial. If you are engaged to a USC citizen, you could withdraw the I-360 and simply pursue a marrigae-based petition. That is, of course, if you were not originally a K-1 entrant.

So what you want to do is, attempt to adjust one way, and if that doesn't work out, try another? That would definitely look suspicious, if your I-360 is denied, and then you said, "well I've been married to this guy for 5 years, since you didn't let me adjust one way, let me do it this way, seeing as how I'm already married and have kids. Sorry I didn't tell you, USCIS, about marrying this other guy, but I wanted to cover all my bases."

I don't know about the legalities of getting married while applying for I-360 and all of that. I do know what looks suspicious though.

So the answer to your question is yes, it does look suspicious.

If you are truly being abused, and you want to go through with the I-360, do it. You shouldn't have a problem proving it if it's well documented. If this guy you're in such a hurry to marry really loves you, he will be there waiting for you.

That is so true, if you get married while your I-360 is still pending, that would be a problem and will be denied. From my personal experience, I don't wanna know anything about dating, relationships, marriages, etc since 2 years ago when I was abused. I'm not saying that I'll be alone for the rest of my life, but I think everyone of us who suffered an abuse, needs to heal (mentally, emotionally) ourselves before start a new seriuos relationship. But, some of us could move on with their lives faster than others, so if that's your case, you should contact an immigration lawyer and ask what it would be better for you. Good Luck.
