hi, i am sorry if this question had been asked before. i am ready to file the F-1 visa for my fiance in south korea, i will be sending the application to vermont service center but i will be planning to move to korea for 1 year to teach english there so i can spend some time with my fiance. i am not sure if this works because am i required to stay in the US when i file for the K1 visa?

you are not required to be in the US and file... if you will be in korea for 1 year and if you will have legal permanency, why not file for Direct Consular filing (DFC)?

thanks for your advice, but our story is more complicated than that coz he has overstayed here in the US before so i know its gonna be a really long journey for us. my family insisted that i just get engaged first and hopefully the marriage can take place in the states. (yes, he's banned for 10 years, he went back last year so it will be another 9 years to go) i am not confident about the hardship waiver because we do not have kids together or any critical medical condition (but thank god).

i just want to see if the K-1 visa go through and if the I-601 will ever get through, or else i will have to move to korea for another 9 years just to be with him.
