No K-1's approved for a week??

Timeline

I find it quite unusual that nothing has happened there regarding K-1's for about a week now. I know we only have a small portion of the applications that come in but my fiancee is actually having a nervous breakdown about the uncertainty about it all. We submitted our's on the 13th and haven't heard yet and its becoming increasingly frustrating that couples (I Know its not there fault and I'm happy they've heard something) almost a month after ours have heard. Has anyone any information and idea on why it has suddenly seemed to of stopped after a lot being done at the end of last and start of this month? :wacko:

Good luck to anyone facing the same problems as ours....

01/08/2009 - POSTED NOA1 to VSC

01/13/2009 - RECEIVED NOA1, Case Pending

02/06/2009 - TOUCHED - Finacee moved so I presume that was the reason for it

05/20/2009 - Contacted Congressman's Alan Grayson's Offices to ask for assistance on our case, He agrees

06/13/2009 - 5 months and nothing, not even from our congressman :( Were is our NOA2!!!!!!

06/16/2009 - Our congressman actually made contact us for the first time in 4 weeks only to tell us they had written our address down wrong so here we are, still stuck in limbo with not a clue what's happenening

06/17/2009 - Called NVC on a off chance they might have it and they do!!!!! Woop woop. All we need now is that hard copy and were set!

06/17/2009 - NVC send our visa and petition to the london embassy - My packet 3 is on the way, woop woop!

06/19/2009 - Recieved NOA2 in the post, dated 06/11/2009. The panicing is over.....for now

07/01/2009 - Reeceived Packet 3 in the post, woop woop

apparently every year at this time USCIS begins to process H-1B petitions as a prority over k visas

This is from their web site...

USCIS Updates Information on FY2010 H-1B Petition Filings

WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) today announced information on the number of filings for H-1B petitions for the fiscal year 2010 program.

USCIS has received approximately 45,500 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. The agency continues to accept petitions subject to the general cap.

Additionally, the agency has received approximately 20,000 petitions for aliens with advanced degrees; however, we continue to accept advanced degree petitions since experience has shown that not all petitions received are approvable. Congress mandated that the first 20,000 of these types of petitions are exempt from any fiscal year cap on available H-1B visas.

For cases filed for premium processing during the initial five-day filing window, the 15-day premium processing period began April 7. For cases filed for premium processing after the filing window, the premium processing period begins on the date USCIS takes physical possession of the petition.

USCIS will provide regular updates on the processing of FY2010 H-1B petitions. The updates can be found on the USCIS Web site at www.uscis.gov/h-1b_count.

Well that freaking sucks...I don't suppose anyone from last year's filers still reads these thing and could tell me when they are likely to get back to the important things? or at least a rough estimation of when this might occur.

It does, because a little over a month ago at noon we had like 4 approvals everyday, and now ZIPPO! I've been waiting 5 months already.

I know how your feeling, I don't know why things are going so slowly only for certain petition dates, and its driving us to insanity. Were only 13 days or so from hitting the 5 month mark ourselves and its so depresssing when people are already married and together that submitted after us.

haha true

i just can tell that we re all starting to get aggravated , i mean sure i have to wait and it s killing me, but i understand it s how it works, but what aggravates me

is the lack of information and organization...i dont see why uv been waiting 5 months when others got theirs in a few weeks.

iv never had a touch, so i dont even know if my file is lost behind a desk.... :crying:

There is no easy way around this process it seems. It is an emotionally draining and soul sucking experience to say the least. However I have gotten to know things about my SO that would have taken me months under more normal circumstances. So theres that. :unsure:

Not getting a touch means NOTHING. If i log into USCIS it still says my file was last looked at the last week of January.

I literally just got my NOA2 hard copy on Monday. So the website is useless. Don't stress, its probably not lost....things slow down and things pick up. It'll get to you soon, don't give up hope.

And not to be a downer but once this is over then its time to wait for the interview....and for my consulate they are saying it could be like 4-6 months.....hopefully it won't be that long but i'm willing to wait however long it takes

ur right, and i usualy stay positive and hopeful but today is just a bad day...just like everyone else i miss my baby and i wanna go home so bad.and usualy i stay strong but today im just totally blah. and the lack of approvals make it so much worst. just seeing someone else get approved, gives me a lil hope.

Your consulate may or may not let you reschedule. I know with some, if you call and they've had a cancellation, you can schedule yours during that slot. May be worth checking out if it could save you several months!

Does anyone know if a lawyer is supposed to help speed things up?

Several friends Ihave talked to say that my lawyer is supposed to be doing more to help me, not just by sending in the application. My dad called the lawyers office(it is a friend of his) and asked and she said no.

common sense tellls me that if that were true(a lawyer doing something to speedthings up) then everyone would be doing it or getting faster approvals :)

I guess i would like to know if I should stay with who I'm with(lawyer) or try someone else that friends are telling me about.

if you guys want to see when this cleared up last year, try looking at igors..ugh never mind. I just looked (http://cse.ssl.berkeley.edu/igor/vjdata/stats.aspx) and it seems that things had picked up already at this time last year.

I really feel for those who are still waiting...just try to be patient, and the best thing you can do is start getting the papers and evidence ready for packet 3 and your interview, that way there are minimal delays between the next steps!

There are plenty of people still on the boards who were around here this time last year, so hopefully they can be of more help!
