Filing N-400 soon, just realized I may have made a mistake

Hi Everyone,

I just realized I may have made a mistake. My husband and I moved to California from New York almost a year ago. I had filed the AR-11 as soon as we got here but I forgot to file the I-865. I remember asking the national customer service people if there was anything else I needed to file and they said no but now that I have read some posts, I think I should have. I have no idea how this is going to affect my n-400 papers. I didn't do it on purpose, it just didn't occur for me to do it. Completely slipped my mind!!!! We filed one the first time we moved in NYC.... should I just file it now? I won't get any answers from the customer service people till tuesday seeing how it's a holiday weekend.

Please help!

N- 400

09/16/2010 N400 Application sent via USPS

09/18/2010 USPS delievery notification received - application has arrived at Arizona Lockbox

09/23/2010 Received SMS and email. Application has been received

09/24/2010 $675.00 Check cashed

09/27/2010 NOA

10/02/2010 Biometrics Letter arrived. Appt is on 10/14/2010

10/04/2010 Early Biometrics/Walk-in -- completed

10/14/2010 Actual Biometrics Appt

12/06/2010 Email notification from USCIS, Case transferred to local office

12/08/2010 Interview Letter arrived in mail

01/20/2011 Scheduled Interview

02/14/2011 Received Oath Letter for Feb 25th but had to request a change to accomodate travel plans

04/28/2011 Scheduled Oath

04/28/2011 Now a US CITIZEN!!!!

That's not your problem but your husband's, since he's your sponsor and required to file a change of address, too.

April 18, 2006: Interview date received.

May 02, 2006: Interview (US Embassy, Dublin, Ireland). Visa approved.

June 14, 2006: Moved to Charlotte, NC.

July 20, 2006: 'Welcome to the United States' letter received.

July 21, 2006: Applied for SSN.

July 29, 2006: SSN received.

September 05, 2006: 2 year Permanent Resident card received.

April 09, 2008: Mailed I-751 to TSC.

April 15, 2008: Check cashed.

April 16, 2008: Case transferred to VSC.

April 23, 2008: Biometrics appointment letter received.

May 10, 2008: Biometrics appointment.

June 28, 2008: Moved to Clearwater, FL (Filed AR-11 and I-865).

February 17, 2005--mailed in I 129F to CSC!

February 24, 2005--1st NOA

March 15, 2005--2nd NOA

April 11, 2005--Fiance receives Packet 3

May 19, 2005 Fax Checklist(Nigeria police report finally arrives)

June 6, 2005-- Interview Date!!!!Visa approved!!

June 18, 2005--Fiancee arrives in Hawaii!

August 14, 2005--wedding in Oregon

September 12, 2005--sent in AOS

September 20, 2005--1st NOA AOS

September 23, 2005--Walk-in biometrics completed

October 1, 2005--fingerprints received/processing resumed

November 26, 2005--EAD card received in mail

June 7, 2006--contact senators about AOS

June 28, 2006--senator says interview date is for August 14!!

August 14, 2006--AOS interview and 1 year wedding anniversary

Onwa: You could have a big problem. You have violated the terms of your residency and can be deported/denied etc. - I would suggest file an AR11 at once. Good Luck

Thanks guys, I really appreciate the advice and help. I had applied online for the AR-11 and it went through. I had actually spoken to someone and I can't remember if she offered to change it on my husband's file too, meaning the I-865, or not. I will call and ask and if not I will bite the bullet and send it in.

The AR-11 and I-865 are sent to different places (cities) and the sponsor usually receives a NOA after receipt. So I'm not sure if the person you talked to about your AR-11 could have also taken care of the I-865. But go ahead and call and then you'll see. I'm sure it's not big deal.
