I suppose technically - if the AOS is flat out denied they would begin removal proceedings. This would entail some sort of court hearing/ruling followed by being asked to leave. This is rare though - is there anything specific you're worried/concerned about?

We'll get into the interview and we are nervous by the idea that there is a penalty (imprisonment, deportation) if USCIS don't see our marriage as a bonda fine one. Is there anybody hear any bad stories know anything about it? Thanks a lot.

If it is denied, yes, then the beneficiary would be told to leave. That is not the same as deportation which is a forced removal. Depends on why it was denied if there would be a future penalties such as a bar to other visas or entry to the USA.

If your relationship is legitimate, don't worry. I have no bad stories. Would a good one make you feel better? We went to the interview, got called in and told the green card was approved, no questions asked, no documents required.

Even couples with bonafide marriages have been denied AOS. When the application is denied, the foreign spouse is required to leave the country usually within 30 days.

Usual reasons for denial would be if the USC spouse does not have adequate income to cover the affidavit of support and they don't have a joint sponsor. Or if for whatever reason they cannot prove to the IO that their marriage is genuine, even though it is. This usually happens if there are no joint bank accounts, no joint ownership/lease holds of the home, or if either of their families are/were not aware of the wedding/marriage. Stuff like that.

I think it's normal to worry, we did, a LOT. ;) And our marriage is definitely legit. :D

Why are you so worried? Do you feel like you don't have enough evidence? Or is it just general worrying?

Worrying is one thing, looking at options once denied is quite another.

Is there any penalties for my finance who has U.S. citizenship?

If they think that you have an greencard arangement, you'll have some "..essplainin to do"

Again, these are not the types of questions most straight up people ask... :lol:

Yes. Immigration fraud is a crime.

The Citizen could be imprisoned 5 years and fined $250,000.

I think it is perfectly fine to worry and know where you stand if you get denied, a lot of us wouldn't have a house, job or anything to go back to if we had to leave the country.

I do agree not to think negatively though, I doubt we would have an interview being a K1 but if we did I know we would pass. Are you K1 or K3?
