My fiancee arrived in the US 4 weeks ago. Since her arrival, we applied for a social security number and a name change for her. Her surname is now mine. I want to make sure that we can process her AOS application with her new surname (last name) even though her visa, passport, and medical documentation still remains as her maiden name. Will this confuse and lengthen the process? I read earlier that we should finalize any name change before processing the AOS packet. Any help would be appreciated.

AOS should be filed in the name that she wants on her greencard...so if she has taken your surname that would be what she puts on the application.

She can change her passport etc at a later date, the fact that this and the visa are in her maiden name will be fine. On the application it asks for any previous surnames used too which she would put her maiden name.

This will not confuse the application process, in fact is the recommended thing to do.

File I-485 using married name, as well as I-765, and perhaps I-131.

These forms have lines for "Name on I-94" and "Other names used" this is where maiden name is indicated.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

Will this confuse and lengthen the process? I read earlier that we should finalize any name change before processing the AOS packet. Any help would be appreciated.

This is common - you heard correct - if changing the name, filing AOS/EAD/AP under this new name is the way to go - it will not hinder your process in any way. (Better/easier to do so now, than to try to change things later/once-issued.)

I have a similar question. In my case, however, I did not change my (now) wife's name. So, here social is in her maiden name as is every document. Can I put her last name as my last name on my application. Is that recommended ?

How does one go about changing the last name by the way ?

Thx

In ANY state, the woman has the choice to use the husband's name. If she wants this she should get her social security card, green card, and any other identification changed to the name she wants to use. Use your marriage certificate as evidence of ablitlity to change name

When i filed my AOS I used my married name. My Green card and work permit were approved in just 1 month and 11 days without interview. That is correct. The defining document is the marriage certificate which allows her to choose which name to use
