Hi

I am bringing my husband to the US. I don't meet the financial requirements. My father will be the joint sponsor.....AND because he is married and files his taxes jointly with my mom....my mom would be the Co-sponsor, is this correct? So my dad will fill out the I-864, and my mom would fill out only the I-864A, right? She does not need to fill out an I-864 too, right?

Now on to my next question, on part 1. of the I-864. What do I fill out, and what does my dad check?

Do I check

A. I am the petitioner. I filed or am filing for the immigration of my relative.

Does my dad check D. or E.

D.I am the only joint sponsor.

or

E. I am the First __ Second___ of two joint sponsors

I'm just really confused as to what box we should check. Any insight would be appreciated.

Hey I am Vanessa and my mother in law will be my co sponsor .

Im in K3 and as far as I know the co sponsor has to fill out the forms the same the that the sponsor has to fill out .

But i guess in your situation she has only to fill out I-864A.

Well first of all, technically, if your Father's income is enough your Mother should not have to submit an I-864A - you would just need to prove your Father's individual income (W2s or 1099s) - however in a couple of cases people have been asked to come back with an I-864A from the person who filed jointly with the sponsor - thread with info on that is here. So basically - who knows - technically no you don't need an I-864A from your Mother - but sometimes they might ask for it.

As for your other questions - yes, you would check that you are the petitioner.

Your Father would check D if your Mother is not going to fill out the I-864A or E if she is.
