ok so Missouri states they will NOT and CANNOT issue a dirivers license or state ID without a greencard.

this is of course because she is "illegal" since she is out of status .. which is not true as the AOS paperwork is filed

they will NOT accept the letter and will only issue a DL or id with a greencard ....

even escalated to a supervisor.. They REFUSE to issue an ID or DL without a greencard

####### any help here?

oh oh.... the I-94 is expired, eh? Then I can understand why they won't take it. Agencies do not talk amongst themselves as they should :(

Seems you will have to wait a bit longer. What else have you done to figure this out?

since WHEN can a LEGAL immigrant not drive?

That is actually pretty normal. My Washington state ID has an expiry date of when my conditional residence expires.

As for your second question: this is state law; so requirements vary and yup, sometimes they svck :(

This is a result of the "Show Me Proof" requirements that took effect in Missouri in 2005.

They are looking at the requirements for Resident Aliens.

You could print out the document referenced above and then return and tell them to look a little further down the list. For "Applicants for Adjustment of Status" the requirements are--

1) showing proof of status -- your NOA showing the application for adjustment

2) EITHER an EAD or her Passport as proof of identity.

Of course, you also still need to provide the usual proof of address, etc.

Unfortunately, no matter how correct you actually are .. you are always at the mercy of the supervisor behind the desk that day. So, there is no guarantee this will work.... but it's worth a shot.

We have the same situation in Kentucky. Vika's I-94 is now expired, so she cannot get a SSN. With no SSN, she cannot get a blue letter. No blue letter=no license. There seems to be no solution, even though the I-94 was valid for weeks when we applied for the SSN. It took weeks for Homeland Security to verify that Vika was in status under her married name. By that time, there was no time left to issue SSN. You are not alone.

You`ll have to wait till you have your EAD card... In Michigan they say the same thing "No state ID or DL without GR". But EAD works well :) I don`t think they care about your NOA1s since they need a Government-issued CARD. NOA1s cannot be used as identification.

Problems vary from state to state and get very frustrating. We had similar problems with social security not getting the information from homeland security. If you try to do things by the book, they treat you like dog doo. But arrive illegally and the doors open up.

My advice is to wait for the green card. In most cases they will only issue a license for the period of her greencard, which is two years. We got a one year identification card for my wife based upon the application to remove restriction (the so-called permanent card) but she was finally able to get a longer expiration ID card after going, once again, to DMV. I just wish she would decide she wants to drive and get it over with.

Here in Colorado, we had to get a letter from Social Security stating that my wife was *not* eligible for a SSN and bring that with passport with valid K3 visa, marriage certificate, USC passport, and evidence of CO residency (our lease is in both of our names)) in order to get her learners permit. By the time she was ready to get her license, she had her green card and her SSN. So then all she needed was her green card and SSN.
