I am a federal agent and am compiling the K-1 Visa for my babe in Thailand. Does it pay to be a federal agent? She has lived in England and is completely bi-lingual. I guess what i am asking is do I need an immigration attorney for this or does the fact that i have top secret clearance grant me some leeway?

There was a USCIS employee who posted even he got no leeway... he had to get in line with everyone else

Someone correct me if I am wrong, but I think if anything, your top secret clearance is going to make this process longer? Because your name will already be in the systems? I could be wrong though!

Do some reading here on VJ, especially the guides and PI regional forum. If your case seems pretty straight forward you will find this is a great DIY resource. There are many folks going through the K visa process from the PI.

2. Check out the "Thailand" and "Sawasdee 3" threads for Thai- specific discussions

3. The majority of us don't feel the need for an attorney since the paperwork is straightforward. Your non-need for an attorney has nothing to do with your occupation, only your ability to fill out forms.

4. If your top secret clearance gets you leeway, I'll be miffed. The rest of us are waiting in line patiently. Nobody is supposed to be special in this process. Not even Eliott Ness.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

I doubt it would hurt or help you. The only time your occupation comes in to play is at the interview when they ask her what you do for a living. Of course she should now.

I have read some stuff in other threads about people having a hard time getting a security clearance since they are married to a foreign national. Not sure how true that is.

What is your take on the situation, pretty straight forward, I am 31 she is 29, we met last year, talked for a year, just went and saw her again. Now we want to do this thing. We met each other in a shopping center. She was actually visiting Phuket from england. She now lives back in Phuket. I have followed the checklist, but I keep hearing all these horror stories. What do you think?

No harm, no foul. If I did get miffed it wouldn't be with you, it would be with the system - should it show preference for you over other applicants. Then again, I AM miffed with the system, so I guess that's out.

Be aware - at several stages of the process (USCIS, NVC, consulate) you are liable to have your case pulled into AP (Administrative Processing), which can take arbitrarily long periods of time. Sometimes it's because some red flag in your file sets them off. Sometimes it's just random luck of the draw. Being a federal employee, you've already got a FBI dossier etc. That may actually be the red flag that sets them off on their AP quest.

My case was stuck 7 weeks in AP @ NVC. Never did find out why. Possibly random. Possibly because I started a new job at a trading firm shortly before we filed, and since my employer is a clearing member of the exchanges I needed to be fingerprinted and have the prints added to FBI database. Who knows if that's not what pulled our case out for AP.

I think:

- Do you love her?

- Does she love you?

- Do you want to spend the rest of your lives together?

- Do you want to get married?

- Do you want to live in the US together... as opposed to Thailand, UK, other places you could conceivably live?

If the answers to all these questions is 'yes', then you've come to the right place for support, and go for it!

K-1 is a pain in the butt, aggravating, and tries your patience. But it's not rocket science, and all of us (ok, most of us) get through it just fine.
