My fiance and I were going to try to do a civil ceremony at city hall this Friday, as I am off of work that day, but I just called to find out that they only perform civil ceremonies Mon-Thurs around 12 noon. The next time we'd be able to do it is Monday, May 18th and his K-1 expires on May 21st. Could this pose a problem?

AOS Timeline:

- 06/30/2009: Filed for AOS/EAD/AP

- 07/02/2009: AOS packet received

- 07/08/2009: Check cashed

- 07/10/2009: Received all 3 NOA1s

- 07/14/2009: Received biometrics appt.

- 07/29/2009: Case transferred to CSC

- 08/01/2009: Advanced Parole Documents Issued

- 08/06/2009: Biometrics appointment completed

- 08/11/2009: EAD issued (received 8/14)

- 11/12/2009: AOS approved

- 11/20/2009: Green Card in hand!

Wow - that is cutting it close.

Do you all ready have the license?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Find a Justice of the Peace in the phone book. They can do a ceremony for a small fee usually. My aunt married us and she is a JOTP. I am not sure of the cost ... she didnt charge us! :D

June 29 2009: Green Card Received

March 6 2011: Lifting Conditions

June 6 2012: Apply for US Citizenship

Shouldn't matter as long as it's done before the 90 days. My cousin got married right at the 90 day mark...they had no issues.

There is nothing wrong with 'cutting it close' as long as you're married before the 90 day expiration date on his I-94. The stipulations of the K-1 visa is that you marry w/in the 90 days...three days before is fine.

Short-notice informal ceremony -- No set price - donations accepted

You may come to my home where I will perform a short ceremony. Short-notice may only be scheduled one or two days in advance. This is a very informal setting and I am usually dressed in very casual attire. That is often sandals and shorts in warm weather or jeans and sweatshirts at other times. Witnesses are not required in Ohio but you may bring up to 2 guests.

I hope you meant I-94 expries as the K-1 expiration date is not the important one as it relates to the marriage event.

Then state that from the very beginning....your original statement is implies that there is some unwritten rule 'to marry well within the 90 day deadline'. The rules of the K-1 visa are clear in that the marriage must take place w/in the 90 day window stamped in the I-94. It is up to each person to figure out what's needed and how to get married in their state. You can marry the day before the 90 days are up (and probably even the day of) and it would be considered acceptable.
