Hello Everyone

My name is KJ, Im South African and my Fiance is American , Im new on here and we have just filed our K1 Visa on the 8th of April. The case is showing up on the system as filed and pending ! And that something was done on it on the 12th of April, since then nothing shows up online. What happens next , I feel like Im sitting on edge here I have no clue what happens really in the next few months apart from the fact that Im not allowed to visit the man I love in the USA , and that out processing time is approx 6 months , he has just left here after visiting me again for 2 weeks and that is the worst pain. Please can someone explain the procedure to us. Thank you :)

It sounds like on April 12 that your file was touched, meaning it was scanned and something was done to it. It could be it was simply counted, filed, given into someone's hands, or moved from one location to another. So if the status update date changes on the USCIS website but no message, that is what that means.

Next you'll get your NOA-2 and advance on to NVC briefly and then to your embassy for your interview. Sadly, like we were, you're at Vermont and they are slower than California.

Now, you CAN visit the US while this process is going on; however, there is no guarentee that you will be admitted since you now have a pending K-1 petition.

Thank You so much CW :) , approx how long do We wait for the NOA-2 and who does it go to , my fiance in the USA ? I have heard that Vermont is very slow, but are apparently trying to speed thing up now , I so hope this is the case , as you the wait is going to be awful , it already is not being able to be together. Hey DEandKJ,

I totally understand what you are going through - but I have to say I have been very fortunate to have our case approved in 31 days from receiving of the NOA1. Basically this is what you would expect to happen next.

Now... you wait... until your fiance in USA receives NOA2 either via Email & in the Mail.

Then... you wait again... you can start calling the NVC (National Visa Center) to see whether your case has been received or not, then your case will be given a South Africa Embassy Case #.

Then.... you wait again for a few days... until NVC sends out the approved petition to the South Africa Embassy. Usually you would receive a letter from NVC stating that your petition has been sent to the destination embassy.

Now .... takes 5-6 working days for your package to arrive at the Embassy. Then Packet # 3 is sent out. This is where you need to prepare ... such as medical, police clearance report, I134.. etc...

Then, once packet # 3 is completed, you are given the right to schedule an interview date. That is Packet # 4. Packet # 4 usually states what you should bring with you to the interview.

So. this is basically the entire process. Some Feb California Service Center fliers were very fortunate to have our case approved... i remember there were a thread of us that were real surprised to be approved within 30 days or so.

But anyhow, never know whats going to happen. The usual time frame i would estimate is 3-4 month from time of receiving NOA1.

7/28/2009 -- Applied for SSN & Registered for Marriage License

8/3/2009 -- Civil Ceremony

8/5/2009 -- Received Marriage Certificate via Express Mail. Pass DMV Written Exam & Received Permit

08/11/2009-- Mailed AOS to Chicago, IL

08/17/2009 -- Check clears $1010 USCIS

8/20/2009- Touched ^---^

8/21/2009-- NOA 1 for I-485 and I-765 Hard Copy

08/29/2009-- Received Biometrics Appointment Letter in the mail, dated 08/26

09/03/2009 -- Early Walk In Biometrics Appt (Original Date 09/23)

09/04/2009 -- Touched ^---^

09/29/2009 -- EAD Card Production

10/07/2009 -- EAD Card Received

10/16/2009 AOS I-485 Interview in Los Angeles(APPROVED)

10/28/2009 -- GC in HAND <3

Thank you so much for that step by step , I so badly needed to know how it all works , My nerves are finished lol , our petition was received on 8 April and still waiting to see if my Fiance has received the NOA1 as he has just returned to the USA after being here with me for vacation , so Im holding thumbs :)

Basically all correct, except that to visit she must also have a proper visitor visa and that can be difficult from some countries. Not a problem for our good Canadian neighbors, but for my wife it was impossible. Not sure about the visitor visa situation with SA.

True , I cannot visit USA while the K1 is in process :( but my fiance is allowed to visit me and will hopefully be back in 3 months time again , and we got news today that no NOA1 issued yet , more tears.

S.IS.Hwang is spot on with guidelines. Im just not so sure about the timeline from NVC to Consulate stage though.

NVC sent my case to the consulate on 14 April already, I've managed to track it with DHL. It landed in SA on 16 April and has been scanned every morning since then to the status 'shipment on hold'...and I thought waiting for my NOA2 was frustrating, but this just beats it!

Thank you so Much , looks like I got very confussed , all my heartbreak and tears with my loved one leaving SA yesterday , I had a good look at all the paperwork and see The NOA1 has ben issued and a Touch was done on April 12 :) IM HAPPY - now the wait I suppose for part 2 , I wish you all the best with your journey as well and hope we keep in contact :)
