I wanted to know by the word "Citizens" , have they included the inhabitants with green cards ? I mean I live in CA by my green card but I haven't got my US passport yet and I wanted to bring my fiance to US , do I have to follow the rules for citizens which they have mentioned in their website ?

Only US Citizens can petition for a K1 (fiance) visa.

If you become naturalized as a citizen, you can file for your fiance. Not before.

I am not sure about K-1 rules but I do believe that you can go for spouse visa CR-1 if you are holding green card but it is taking abit longer time than If you are a USC but once you become the USC you can upgrade your application.

If you get married to your fiance, you can file an immigrant visa petition for her under the category of F2A.

However, it will take several years to bring her to the US.

thanx for the information , so U mean you are sure that it's possible to use (IR1 or CR1) , what about K3 ? and the other thing how can i get sure about K1 ?

CR1, IR1 and K3 are all for spouses of US citizens.

K1 is for fiance of a U.S. citizen.

Since you are a legal permanent resident, you have to petition under F2A (spouses and minor children of legal permanent residents).

Yes you are possible to go for CR-1/IR-1.

I-130 Petition for Alien Relative : Permanent resident filling for a spouse or child under 21 (CR-1/IR-1)

I don't think you apply for K-1 or K-3.

It is taking abit longer time than you are the USC, like i said, once you become the USC, you can upgrade your application with them so they can process faster.

maybe it is not calling CR-1/IR-1, but you are possible to file for your spouse if you are holding Permanent resident. I think you better go to this link on the correct section. There are the guides of how to do it there.

As a Legal Permanent Resident (green card holder), you can only file a I-130 petition for your wife. (You cannot file for a fiancee.) Your wife would be placed in the F2a family preference category. Currently people who applied before October 8, 2004, are eligible for visas. So the process takes about 5 years. There is no way to predict an exact wait time.

Yes you are possible to go for CR-1/IR-1.

CR-1/IR-1 are ONLY for US citizens applying for a spouse. The poster is not a US citizen. He can only file a I-130 for his wife. He cannot file for a fiancee as an LPR can only file for a spouse and unmarried children.

You can file the I-130 for your spouse today, but as has been pointed out, the F2A preference category is taking multiple years for approval.

What may be the fastest route is to file the I-130 today, and then, as soon as you are eligible, file an N-400 for your US Citizenship. As soon as you become a citizen, you can upgrade your I-130, and it will be processed as an I-130 filed by a US Citizen, but with the same filing date that it originally had. So it will immediately jump to the front of the waiting line.

04 Apr, 2004: Got married

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.
