I met the man of my dreams 9 months ago online, we have met in person 3 times now, at this moment im spending 6 weeks with him in the US (2nd visit and had trouble getting through immagration). Now could anyone help with these questions, would it be better if we married first (if thats even possible?) or to go for the k1 visa.

Also after reading some of the timelines on here i see that its not always london you have to go to to have the medical, i live in Norfolk uk, do anyone know where i would have to go for my medical. As it seems the interveiw and medical are on different days now and going to london twice would be expensive.

I hope all that made sence... any help would be great thanx.

get married. apply for the adjustmust of status(AOS). if you are given minimum 45 days to stay in usa then you can apply for AOS without leaving usa. or get married in USA. come back and file for k-3 visa. for k-1or k-3 timeline is between 6 to 12 months.

Four visits to japan in 2004: Oct 2004, wife got pragnant.

and as far as medicals go Knightsbridge Doctors in London is the sole contractor for Embassy medicals for 2006.

You have a few options!

You could marry now and file for AOS, as you didn't intend to immigrate. There are a few things that you shuold know: first, you need to be able to concretely prove you had no immigrant intent when you came to the US. This is sometimes difficult, but you could use a copy of a lease or mortgage in the UK, your return ticket, anything that proves you were really intending to go back to the UK at the end of your stay. Second, you cannot leave the country before AOS is completed, or you will have to start over again and file for K-3. Third, you won't be able to work until you have your EAD, which will be a few months. So if you are cmofortably supported by your SO, don't have to go back to the UK for anything for the next few months, and can manage to prove that you didn't intend to stay when you got here...you can marry and file for AOS.

You could als marry, return home, and have your spouse apply for K-3. Alternatively, you could not marry and have your fiance apply for the K-1. Both of these optinos do require an interview and medical exam which are only conducted in London. Obviously these options require you to be in the UK for at least the medical and the interview.

You ahve plenty of options, you may want to discuss them with your SO first and see what plans you can make!

thanx for the info all, i didnt know about the AOS, but i doubt that i would be believed that i didnt intend to stay as ive already been here twice, also want to bring my daughter with me for a visit in november, thats if i get throught immagration. We wont be doing anything til after that visit as i heard its difficut to get in when youre filing.

lol...yea i understood most of it thanx.

Would it be any harder with a k-3 than a k-1, just ive read a k-1 is quicker, im new to all this so i dont have much info to go on.

Also how hard is it to marry here in the US, i suppose i would need my birth certificate?

K-1 and K-3 are roughly equivalent in terms of time; the K-3 may be slightly longer.

As to getting married in the US, it depends on what state you are in. In some places it may not be possible, since they may require a social security card. Some places may just ask for your passport. Call up and ask, because sometimes even if they say they need a social security number they may be able to make exceptions (they did for myself and my husband). Good luck!

K-1 vs K-3 is an interesting debate I have had for almost a year now. I would recommend a k-1 if you want to get married in US. I personnally though of getting a K-3 visa ands getting married in my fiances country but found out it would keep us apart too long.
