I am trying, Aussie :) Just wanted to know our options

We all get nervous and worry some prior to the interview but honestly try not to be thinking what if. Best to concentrate on the NOW and getting through the interview. Then IF you need other options, worry about that then  I will say though, there is always other options.

You are going to do great

Hi all

I am about to have my interview and I was wondering if anything goes wrong and we get denied or our petition sent back to the US, could we get married and file for K-3 right after ?

Thanks !

If something goes wrong it will go wrong the one way or the other. If your K1 gets denied your K3 will get denied as well.

Being married doesn`t lead to a 100% approval. Of course you must meet the requirements.

The above is an untrue statement. If the K1 is denied it is possible that the K3 will be denied, but its also possible that the K3 will be approved. Being denied before doesn't lead to 100% disapproval in a future petition.

Artegal,

True, a prior denial does not assure a subsequent denial. But the reasons that support the denial of a K1 visa application apply to the K3 visa as well, so unless the root problem is rectified nothing significant has changed and a K3 application will be denied for the same reason that the K1 application was denied.

This is VERY UNTRUE. We actually had our K-1 denied last year. We married this year in the Philippines and petitioned for K-3/K-4. We don't anticipate any problems. The reason for the first denial was that my wifes previous marraige had not been properly desolved...the problem is now rectified, she got her annulment...and we were wed. There is no reason now to be denied.
