Hi Everyone,

The new wife and I were wondering how long it takes to get Advanced Parole for travel in the case of a semi-emergency. Meaning we are sending her 485 packet out this week, but on June 21 she will need to return to Bogota to begin a new and final semester of teaching.

If her regular Advanced Parole hasn't arrived by he first of June or thereabouts can we feel safe in using the infopass procedure to get her travel permission, and would her teaching committment qualify as an emergency?

When did you file for these benefits? Also what local office will be processing your case? If you live close and have the time then you can spend an hour or two and go in person. Bring tons of proof on why your spouse needs to travel. You may not have success but it may be worth trying. Like others said, an emergency is usually reserved for items such as medical or other serious type items.

I don't think advanced parole is there for you to go back for 3-4 months (I'm guessing a the length of the semester) to finish school. Can the final semester wait? Will her teaching qualifications be valid in the US?

That really isn't an emergency is it? Would be a tough sell.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I guess I haven't understood the Advanced Parole concept as well as needed.

My wife has no emergency other than needing to return to

Bogota to finish her last semester of teaching in order to qualify for her pension.

All along we thought that AP would permit this.

It's really a collision of circumstances in that we met, bacame engaged, and her K-1 came through right as she was nearing the end of her teaching career.

Our visa interview was last October in Bogota, I had applied for it earlier in 2008 but looking back now we might have chosen to delay the process 6 more months in order for her to squeeze in the last semester (she arrived with her two kids on Feb. 4, 2009, we got married two weeks ago, March 23, and are now redying the 485 packet to mail out this week.)

Do you guys think AP and/or Infopass is the only chance we have of getting her back into the U.S. next December or January??

Definately ask for the advavced parole. My wife asked for it on the basis of helping her mother on her farm in nicaragua and assistimg a very sick aunt. She spent 4 months there, we had to delay the aos interview until she returned. All went well returning at the LAX immigration and the imterview a month later.

Once you get the AP she can use it for this purpose but I think she would have a hard sell to qualify returning to a job to get an emergency AP faster than the normal processing. Hopefully it will arrive in time. Definitely get your application in asap and try to stress on it the importance for her to be able to travel by that date. At the very worst she may need to arrange for someone to cover her until she is able to travel. APs are said to take 90 days however they may be issued faster than that - my first AP arrived within a month; my second, however, took more than 90 days. It just depends on the processing. You might want to look into back up arrangements (ie a teaching substitute) if the AP is delayed.
